  1  1    Section 1.  NEW SECTION.  80.43  TRAFFIC ACCIDENTS
  1  2 INVOLVING CERTIFIED LAW ENFORCEMENT OFFICERS.
  1  3    1.  The commissioner shall adopt rules to define when a
  1  4 traffic accident involving the operation of a motor vehicle by
  1  5 a certified law enforcement officer occurs in the line of duty
  1  6 during the officer's employment as a certified law enforcement
  1  7 officer.
  1  8    2.  Any traffic accident involving the operation of a motor
  1  9 vehicle by a certified law enforcement officer shall be
  1 10 reported by the officer's employer to the department of public
  1 11 safety for review pursuant to the rules adopted under
  1 12 subsection 1, and the department shall certify whether or not
  1 13 the accident occurred while in the line of duty during the
  1 14 officer's employment as a certified law enforcement officer.
  1 15 If the department certifies that the accident occurred in the
  1 16 line of duty during the officer's employment as a certified
  1 17 law enforcement officer, the department shall forward the
  1 18 certification to the state department of transportation.
  1 19    3.  Upon receiving a certification pursuant to subsection
  1 20 2, the state department of transportation shall not maintain
  1 21 an accident report of the accident described in the
  1 22 certification pursuant to section 321.266.
  1 23    4.  For the purposes of this section, "certified law
  1 24 enforcement officer" means a law enforcement officer who is
  1 25 certified through the Iowa law enforcement academy as provided
  1 26 in section 80B.13, subsection 3, or section 80B.17.
