1 An Act relating to the awarding of bonuses to appointed state
2 officers and state employees and providing an effective date.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 7J.1, subsection 2, paragraph c, Code
1 2 Supplement 2003, is amended to read as follows:
1 3 c. Notwithstanding any provision of law to the contrary,
1 4 the governor may set the salary of a director of a charter
1 5 agency under the pay plan for exempt positions in the
1 6 executive branch of government. In addition However, the
1 7 governor may shall not authorize the payment of a bonus to a
1 8 director of a charter agency in an amount not in excess of
1 9 fifty percent of the director's annual rate of pay, based upon
1 10 the governor's evaluation of the director's performance in
1 11 relation to the goals set forth in the annual performance
1 12 agreement.
1 13 Sec. 2. Section 7J.1, subsection 2, paragraph d, Code
1 14 Supplement 2003, is amended to read as follows:
1 15 d. A director of a charter agency may authorize the
1 16 payment of bonuses to employees of the charter agency who are
1 17 not a director or deputy director of the charter agency in a
1 18 total amount not in excess of fifty percent of the director's
1 19 annual rate of pay, based upon the director's evaluation of
1 20 the employees' performance during any fiscal year if the
1 21 revenue estimating conference projection of revenue for that
1 22 fiscal year determined pursuant to section 8.22A, subsection
1 23 3, exceeds the revenue estimate for the prior fiscal year by
1 24 at least four percent.
1 25 Sec. 3. 2001 Iowa Acts, chapter 190, section 3, unnumbered
1 26 paragraph 3, is amended to read as follows:
1 27 A person whose salary is established pursuant to section 4
1 28 of this Act and who is a full=time, year=round employee of the
1 29 state shall not receive any other remuneration from the state
1 30 or from any other source for the performance of that person's
1 31 duties unless the additional remuneration is first approved by
1 32 the governor or authorized by law. However, this provision
1 33 does not exclude the reimbursement for necessary travel and
1 34 expenses incurred in the performance of duties or fringe
1 35 benefits normally provided to employees of the state.
2 1 Sec. 4. STATE EMPLOYEE BONUSES == MORATORIUM. Unless
2 2 otherwise required pursuant to a collective bargaining
2 3 agreement, a state employee shall not receive any additional
2 4 remuneration in the form of a bonus, including but not limited
2 5 to a retention bonus, recruitment bonus, exceptional job
2 6 performance pay, extraordinary job performance pay,
2 7 exceptional performance pay, extraordinary duty pay, or
2 8 extraordinary or special duty pay, for or during the time
2 9 period beginning on or after the effective date of this Act
2 10 and only for or during any fiscal year if the revenue
2 11 estimating conference projection of revenue for that fiscal
2 12 year determined pursuant to section 8.22A, subsection 3, does
2 13 not exceed the revenue estimate for the prior fiscal year by
2 14 at least four percent.
2 15 Sec. 5. EFFECTIVE DATE. This Act, being deemed of
2 16 immediate importance, takes effect upon enactment.
