NEW SECTION. 135.39A EARLY CHILDHOOD 1 2 IMMUNIZATIONS == CONTENT. 1 3 1. Beginning January 1, 2006, early childhood 1 4 immunizations administered in this state shall not contain 1 5 more than trace amounts of mercury. 1 6 2. For the purposes of this section: 1 7 a. "Early childhood immunizations" means immunizations 1 8 administrated to children under eight years of age, unless 1 9 otherwise provided in this section. 1 10 b. "Trace amounts" means trace amounts as defined by the 1 11 United States food and drug administration. 1 12 3. The prohibition under this section shall not apply to 1 13 early childhood immunizations for influenza or in times of 1 14 emergency or epidemic as determined by the director of public 1 15 health. If an emergency or epidemic is determined to exist by 1 16 the director of public health under this subsection, the 1 17 director of public health shall notify the state board of 1 18 health, the governor, and the legislative council, and shall 1 19 notify the public upon request. 1 20 Sec. 2. NEW SECTION. 514C.21 COVERAGE FOR IMMUNIZATIONS 1 21 == MERCURY. 1 22 1. Third=party payment provider contracts or policies 1 23 delivered, issued for delivery, continued, or renewed in this 1 24 state on or after January 1, 2006, that provide reimbursement 1 25 for immunizations shall provide reimbursement for 1 26 immunizations containing no more than trace amounts of mercury 1 27 at the acquisition cost rate for immunizations containing no 1 28 more than trace amounts of mercury. For the purposes of this 1 29 section, "trace amounts" means trace amounts as defined by the 1 30 United States food and drug administration. 1 31 2. For the purposes of this section, "third=party payment 1 32 provider contracts or policies" includes: 1 33 a. Individual or group accident and sickness insurance 1 34 providing coverage on an expense=incurred basis. 1 35 b. An individual or group hospital or medical service 2 1 contract issued pursuant to chapter 509, 514, or 514A. 2 2 c. An individual or group health maintenance organization 2 3 contract regulated under chapter 514B. 2 4 d.
