  1 An Act relating to games of chance by authorizing certain bingo
  2    games and prizes for bingo and raffles and providing an
  3    effective date.

  1  1    Section 1.  Section 99B.7, subsection 1, paragraph c,
  1  2 unnumbered paragraph 1, Code Supplement 2003, is amended to
  1  3 read as follows:
  1  4    Cash or merchandise prizes may be awarded in the game of
  1  5 bingo and, except as otherwise provided in this paragraph,
  1  6 shall not exceed one hundred dollars.  Merchandise prizes may
  1  7 be awarded in the game of bingo, but the actual retail value
  1  8 of the prize, or if the prize consists of more than one item,
  1  9 unit or part, the aggregate retail value of all items, units
  1 10 or parts, shall not exceed the maximum provided by this
  1 11 paragraph.  Bingo games allowing for a trade=in of a bingo
  1 12 card during a bingo game for not more than fifty cents a
  1 13 trade=in may be conducted.  A jackpot bingo game may be
  1 14 conducted once twice during any twenty=four hour period in
  1 15 which the prize may begin at not more than three hundred
  1 16 dollars in cash or actual retail value of merchandise prizes
  1 17 and may be increased by not more than one two hundred dollars
  1 18 after each bingo occasion to a maximum prize of one thousand
  1 19 dollars for the first jackpot bingo game and two thousand five
  1 20 hundred dollars for the second jackpot bingo game.  However,
  1 21 the cost of play in a jackpot bingo game shall not be
  1 22 increased and the jackpot shall not amount to more than eight
  1 23 hundred dollars in cash or actual retail value of merchandise
  1 24 prizes.  A jackpot bingo game is not prohibited by paragraph
  1 25 "h".  A bingo occasion shall not last for longer than four
  1 26 consecutive hours.  A qualified organization shall not hold
  1 27 more than fourteen bingo occasions per month.  Bingo occasions
  1 28 held under a limited license shall not be counted in
  1 29 determining whether a qualified organization has conducted
  1 30 more than fourteen bingo occasions per month, nor shall bingo
  1 31 occasions held under a limited license be limited to four
  1 32 consecutive hours.  With the exception of a limited license
  1 33 bingo, no more than three bingo occasions per week shall be
  1 34 held within a structure or building and only one person
  1 35 licensed to conduct games under this section may hold bingo
  2  1 occasions within a structure or building.  A licensed
  2  2 qualified organization shall not conduct free games.
  2  3    Sec. 2.  Section 99B.7, subsection 1, paragraph d,
  2  4 unnumbered paragraphs 1, 2, and 3, Code Supplement 2003, are
  2  5 amended to read as follows:
  2  6    Cash prizes shall not be awarded in games other than bingo
  2  7 and raffles.  The value of a prize shall not exceed ten
  2  8 thousand dollars and merchandise prizes shall not be
  2  9 repurchased.  If a prize consists of more than one item, unit,
  2 10 or part, the aggregate value of all items, units, or parts
  2 11 shall not exceed ten thousand dollars.  However, one raffle
  2 12 may be conducted per calendar year at which real property or
  2 13 one or more merchandise prizes having a combined value of more
  2 14 than ten thousand dollars may be awarded or a cash prize of up
  2 15 to two hundred thousand dollars may be awarded.
  2 16    If a raffle licensee holds a statewide raffle license, the
  2 17 licensee may hold not more than eight raffles per calendar
  2 18 year at which real property or one or more merchandise prizes
  2 19 having a combined value of more than ten thousand dollars may
  2 20 be awarded or a cash prize of up to two hundred thousand
  2 21 dollars may be awarded.  Each such raffle held under a
  2 22 statewide license shall be held in a separate county.
  2 23    If a prize is merchandise, its value shall be determined by
  2 24 the purchase price paid by the organization or donor.  If a
  2 25 prize is real property or is cash and the combined value of
  2 26 the prize or the cash prize exceeds one hundred thousand
  2 27 dollars, the department shall conduct a special audit to
  2 28 verify compliance with the appropriate requirements of this
  2 29 chapter including all of the following applicable
  2 30 requirements:
  2 31    Sec. 3.  Section 99B.7, subsection 1, paragraph d,
  2 32 subparagraph (1), Code Supplement 2003, is amended to read as
  2 33 follows:
  2 34    (1)  The licensee has submitted a real property or cash
  2 35 raffle license application and a fee of one hundred dollars to
  3  1 the department, has been issued a license, and prominently
  3  2 displays the license at the drawing area of the raffle.
  3  3    Sec. 4.  Section 99B.7, subsection 3, paragraph a, Code
  3  4 Supplement 2003, is amended to read as follows:
  3  5    a.  A person wishing to conduct games and raffles pursuant
  3  6 to this section as a qualified organization shall submit an
  3  7 application and a license fee of one hundred fifty dollars.
  3  8 The annual license fee for a statewide raffle license shall be
  3  9 one hundred fifty dollars.  However, upon submission of an
  3 10 application accompanied by a license fee of fifteen dollars, a
  3 11 person may be issued a limited license to conduct all games
  3 12 and raffles pursuant to this section at a specified location
  3 13 and during a specified period of fourteen consecutive calendar
  3 14 days, except that bingo may only be conducted once per each
  3 15 seven consecutive calendar days of the specified period.  In
  3 16 addition, a qualified organization may be issued a limited
  3 17 license to conduct raffles pursuant to this section for a
  3 18 period of ninety days for a license fee of forty dollars or
  3 19 for a period of one hundred eighty days for a license fee of
  3 20 seventy=five dollars.  For the purposes of this paragraph, a
  3 21 limited license is deemed to be issued on the first day of the
  3 22 period for which the license is issued.
  3 23    Sec. 5.  EFFECTIVE DATE.  This Act, being deemed of
  3 24 immediate importance, takes effect upon enactment.
