1.
Section
368.25A,
subsection
3,
Code
2026,
is
1
amended
to
read
as
follows:

3.
a.
If
the
city
councils
of
both
cities
approve
the
3
petition,
the
petition
shall
be
filed
with
the
board.
Approval
4
by
either
city
council
may
be
conditioned
upon
an
agreement
5
entered
into
by
the
cities
providing
for
the
transition
of
6
property
taxes
or
the
sharing
of
property
tax
revenues
from
7
the
real
property
described
in
the
petition
for
a
period
not
8
to
exceed
forty
years
and
providing
for
all
necessary
zoning
9
ordinance
changes
within
a
period
not
to
exceed
ten
years.
An
10
agreement
between
cities
under
this
subsection
shall
be
filed
11
with
the
board
at
the
same
time
the
approved
petition
is
filed.
12
An
agreement
may
include
additional
transition
provisions
13
relating
to
the
transfer
or
sharing
of
property
tax
revenues
14
for
property
outside
the
boundaries
of
the
territory
described
15
in
the
petition
and
any
other
provisions
deemed
by
the
cities
16
to
be
in
the
public
interest
if
such
actions
are
within
the
17
authority
of
the
cities.
18
b.
If
the
city
council
of
one
of
the
cities
denies
the
19
petition,
the
real
property
owner
may
file
the
petition
again.
20
After
the
petition
has
been
filed
three
times
and
has
been
21
denied
by
the
city
council
of
one
of
the
cities
three
times
22
within
a
one-year
period,
the
petition
shall
be
filed
with
the
23
board
for
review
in
a
manner
consistent
with
subsections
4
and
24
5.
The
board
shall
facilitate
an
adjustment
agreement
between
25
the
two
cities.
This
paragraph
only
applies
if
the
land
at
26
issue
is
undeveloped
or
unimproved.
This
paragraph
does
not
27
apply
to
any
of
the
following:

(1)
Land
subject
to
an
agreement
that
includes
the
use
of
29
incremental
taxes
collected
pursuant
to
section
403.19.

(2)
Land
subject
to
any
special
assessment.
31
(3)
Land
that
has
been
sold
at
a
tax
sale
pursuant
to
32
chapter
446.

This
bill
relates
to
boundary
adjustments
between
cities
by
2
petition
of
property
owners.

Under
current
law,
a
real
property
owner
within
the
4
boundaries
of
a
city
may
file
a
petition
for
severance
with
5
the
city
council
if
the
property
would
then
be
eligible
6
for
annexation
by
a
different
city.
If
both
of
the
cities
7
approve
the
petition,
the
petition
is
then
filed
with
the
8
city
development
board
(board).
The
board
then
initiates
9
proceedings
to
sever
the
territory
from
the
city
in
which
the
10
property
is
currently
located
and
annex
the
property
to
the
11
annexing
city.

The
bill
provides
that
when
the
petition
has
been
filed
13
three
times
and
also
denied
by
the
council
of
one
of
the
14
cities
three
times
within
a
one-year
period,
the
petition
15
shall
still
be
filed
with
the
board.
The
board
shall
then
16
initiate
proceedings
in
a
manner
consistent
with
current
law
17
and
facilitate
an
adjustment
agreement
between
the
two
cities.
18
The
bill
only
applies
when
the
land
at
issue
is
unimproved
or
19
undeveloped.
The
bill
does
not
apply
to
land
that
is
subject
20
to
an
agreement
that
includes
the
use
of
incremental
taxes
21
collected
pursuant
to
Code
section
403.19,
land
subject
to
any
22
special
assessment,
or
land
that
has
been
sold
at
a
tax
sale.
