S.J.R. 10 Section 1. The following amendment to the Constitution of 1 the State of Iowa is proposed: 2 1. Section 3 of Article III of the Constitution of the State 3 of Iowa is repealed and the following adopted in lieu thereof: 4 Sec. 3. Representatives —— term limitation. The members of 5 the house of representatives shall be chosen every second year, 6 by the qualified electors of their respective districts, and 7 their term of office shall commence on the first day of January 8 next after their election, and continue two years, and until 9 their successors are elected and qualified. A person first 10 elected to the house of representatives for a term commencing 11 on or after January 1, 2029, shall not be elected for a term as 12 representative if the term would result in the person serving 13 more than twelve consecutive years in the general assembly, and 14 shall not be elected for two years next after serving twelve 15 consecutive years. 16 2. Section 5 of Article III of the Constitution of the State 17 of Iowa is repealed and the following adopted in lieu thereof: 18 Sec. 5. Senators —— qualifications —— term limitation. 19 Senators shall be chosen for the term of four years, at 20 the same time and place as representatives; they shall be 21 twenty-five years of age, and possess the qualifications of 22 representatives as to residence and citizenship. A person 23 first elected to the senate for a term commencing on or after 24 January 1, 2029, shall not be elected for a term as senator if 25 the term would result in the person serving more than twelve 26 consecutive years in the general assembly, and shall not be 27 elected for two years next after serving twelve consecutive 28 years. 29 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed 30 amendment to the Constitution of the State of Iowa is referred 31 to the general assembly to be chosen at the next general 32 election for members of the general assembly, and shall be 33 published as provided by law for three months previous to the 34 date of that election. 35 -1- LSB 2594XS (3) 91 ss/ns 1/ 2
S.J.R. 10 EXPLANATION 1 The inclusion of this explanation does not constitute agreement with 2 the explanation’s substance by the members of the general assembly. 3 This joint resolution proposes an amendment to the 4 Constitution of the State of Iowa limiting years of service for 5 persons elected to the general assembly. 6 The amendment provides that a person shall not be elected for 7 a term as a senator or representative if the term would result 8 in the person serving more than twelve consecutive years in the 9 general assembly. Additionally, a senator or representative 10 shall not be elected for a term as a senator or representative 11 for two years following a twelfth consecutive year of service 12 in the general assembly. These limitations apply only to 13 persons first elected for a term commencing on or after January 14 1, 2029. 15 The resolution, if adopted, would be referred to the next 16 general assembly (92nd) for adoption, before being submitted to 17 the electorate for ratification. 18 -2- LSB 2594XS (3) 91 ss/ns 2/ 2
