709.21,
subsection

is
amended
to
read
as
follows:

A
person
who
knowingly
views,
photographs,
or
films
3
another
person,
for
the
purpose
of
arousing
or
gratifying
the
4
sexual
desire
of
any
person,
or
who
knowingly
possesses
such
5
photograph
or
film,
commits
invasion
of
privacy
if
all
of
the
6
following
apply:

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
to
be
guilty
of
invasion
of
privacy,
a
11
person
must
knowingly
view,
photograph,
or
film
another
person
12
for
the
purpose
of
arousing
or
gratifying
the
sexual
desire
of
13
any
person,
if
the
other
person
does
not
consent
or
is
unable
14
to
consent
to
being
viewed,
photographed,
or
filmed;
the
other
15
person
is
in
a
state
of
full
or
partial
nudity;
and
the
other
16
person
has
a
reasonable
expectation
of
privacy
while
in
a
state
17
of
full
or
partial
nudity.
This
bill
adds
that
a
person
who
is
18
knowingly
in
possession
of
such
a
photograph
or
film
is
guilty
19
of
invasion
of
privacy.
20
A
violation
of
Code
section
709.21
is
an
aggravated
21
misdemeanor
and
a
tier
II
sex
offense.
A
person
convicted
of
22
the
offense
is
required
to
register
as
a
sex
offender
for
a
23
period
of
10
years.
