1.
Section
321E.29B,
subsection
1,
Code
2026,
is

amended
to
read
as
follows:

Notwithstanding
section
321E.8
,
the
department

permit-issuing
authority
may
issue
annual
permits
for
the
4
operation
of
vehicles
or
combinations
of
vehicles
transporting
5
fluid
milk
products
to
or
from
a
milk
plant,
receiving
6
station,
or
transfer
station,
exceeding
the
weight
limitation
7
of
section
321.463
but
not
exceeding
a
gross
weight
of
8
ninety-six
one
hundred
thirty-six
thousand
pounds
,
on
primary
9
roads
and
primary
road
extensions
in
cities
.
The
department
10
shall
establish
rules
regarding
minimum
distances
for
axle
11
configurations.

Sec.
2.
EFFECTIVE
DATE.
This
Act
takes
effect
January
1,
13
2027.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
16
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
the
department
of
transportation
(DOT)
18
is
authorized
to
issue
annual
permits
for
the
operation
19
of
vehicles
or
combinations
of
vehicles
transporting
fluid
20
milk
products
to
or
from
a
milk
plant,
receiving
station,
or
21
transfer
station
while
exceeding
the
weight
limitation
of
Code
22
section
321.463
but
not
exceeding
20,000
pounds
per
axle,
and
23
not
exceeding
a
gross
weight
of
96,000
pounds,
on
primary
roads
24
and
primary
road
extensions
in
cities.
The
fee
for
a
fluid
25
milk
products
annual
permit
is
$400.

This
bill
strikes
the
restriction
that
limits
such
permitted
27
vehicles
to
be
operated
only
on
primary
roads
and
primary
road
28
extensions
in
cities.
As
such,
the
bill
authorizes
local
29
authorities,
in
addition
to
the
DOT,
to
issue
fluid
milk
30
products
annual
permits.
In
accordance
with
current
law,
a
31
permit
must
be
issued
by
the
authority
responsible
for
the
32
maintenance
of
the
system
of
highways
or
streets
on
which
33
operating
a
permitted
vehicle
is
authorized.

The
bill
makes
fluid
milk
products
annual
permits
valid
for

vehicles
and

of
vehicles
weighing
up
to
136,000
1
pounds.
The
DOT
is
required
to
establish
rules
regarding

bill

20,000-pounds-per-axle
weight
limit
under
Code

section
321.463.
