adding
the
following
new
paragraph:

cq.
Kratom,
meaning
any
parts
of
the

plant
Mitragyna
speciosa,
whether
growing
or
not,
as
well
as
4
synthetic
equivalents
of
the
substances
contained
in
the
plant,
5
and
any
compound,
manufacture,
salt,
derivative,
mixture,
6
or
preparation
of
that
plant,
including
but
not
limited
to
7
mitragynine
and
7-hydroxymitragynine.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
10
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
designates
kratom
as
a
hallucinogenic
schedule
I
12
controlled
substance.
13
A
person
possessing
kratom
is
guilty
of
a
serious
14
misdemeanor
for
a
first
offense.
A
person
who
commits
a
15
subsequent
violation
is
guilty
of
an
aggravated
misdemeanor.
16
A
person
who
has
previously
been
convicted
two
or
more
times
17
is
guilty
of
a
class
“D”
felony.
A
serious
misdemeanor
is
18
punishable
by
confinement
for
no
more
than
one
year
and
a
fine
19
of
at
least
$430
but
not
more
than
$2,560.
An
aggravated
20
misdemeanor
is
punishable
by
confinement
for
no
more
than
two
21
years
and
a
fine
of
at
least
$855
but
not
more
than
$8,540.
A
22
class
“D”
felony
is
punishable
by
confinement
for
no
more
than
23
five
years
and
a
fine
of
at
least
$1,025
but
not
more
than
24
$10,245.
