S.F. 2120 Section 1. Section 97B.52A, subsection 1, paragraph c, 1 subparagraph (2), Code 2026, is amended by adding the following 2 new subparagraph division: 3 NEW SUBPARAGRAPH DIVISION . (e) For a member whose first 4 month of entitlement is July 2026 or later, the member may 5 return to covered employment as school district support staff 6 or a coach for a covered employer after receiving one month of 7 retirement benefits. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 Current law provides that a member has a bona fide retirement 12 for purposes of the Iowa public employees’ retirement system 13 when the member does not return to any employment with a 14 covered employer until the member has qualified for at least 15 one calendar month of retirement benefits and the member 16 does not return to covered employment until the member has 17 qualified for no fewer than four calendar months of retirement 18 benefits. This bill provides that a member may return to 19 covered employment as school district support staff or a coach 20 for a covered employer after receiving one month of retirement 21 benefits. 22 -1- LSB 5611XS (3) 91 sc/ns 1/ 1
