S.F. 2099 Section 1. Section 717B.3A, subsections 1, 4, and 5, Code 1 2026, are amended to read as follows: 2 1. A person is guilty of animal torture if the person 3 intentionally or knowingly inflicts on an animal severe and 4 prolonged or repeated physical pain that causes the animal’s 5 serious injury or death crushes, burns, drowns, suffocates, 6 impales, or otherwise subjects an animal to serious injury or 7 death or causes, directs, or provides anything of value to 8 another person to do the same . 9 4. A person who commits animal torture is guilty of an 10 aggravated misdemeanor a class “D” felony . 11 5. Notwithstanding subsection 4 , a person who commits 12 animal torture is guilty of a class “D” “C” felony if the 13 person has previously been convicted of committing animal 14 abuse pursuant to section 717B.2 , animal neglect punishable 15 as a serious misdemeanor or aggravated misdemeanor pursuant 16 to section 717B.3 , animal torture pursuant to this section , 17 injury to or interference with a police service dog pursuant to 18 section 717B.9 , bestiality pursuant to section 717C.1 , or an 19 act involving a contest event prohibited in section 717D.2 . 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill relates to animal torture. 24 The bill provides that a person is guilty of animal torture 25 if the person intentionally or knowingly crushes, burns, 26 drowns, suffocates, impales, or otherwise subjects an animal 27 to serious injury or death or causes, directs, or provides 28 anything of value to another person to do the same. Current 29 law provides that animal torture is an aggravated misdemeanor. 30 The bill increases the penalty to a class “D” felony. A class 31 “D” felony is punishable by confinement for no more than five 32 years and a fine of at least $1,025 but not more than $10,245. 33 The bill provides that a person who has previously been 34 convicted of committing animal abuse (Code section 717B.2), 35 -1- LSB 6778XS (1) 91 as/js 1/ 2
S.F. 2099 animal neglect punishable as a serious misdemeanor or 1 aggravated misdemeanor (Code section 717B.3), animal torture 2 pursuant to the bill, injury to or interference with a police 3 service dog (Code section 717B.9), bestiality (Code section 4 717C.1), or an act involving a prohibited animal contest (Code 5 section 717D.2) is guilty of a class “C” felony.
