S.F. 2042 Section 1. NEW SECTION . 327D.30 Idling near residential 1 zones. 2 A railway corporation shall not leave a stationary railroad 3 train’s engines running for more than one hour if the train 4 is stationary within one-half mile of an area zoned for 5 residential purposes in a city. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill prohibits a railway corporation from leaving a 10 stationary railroad train’s engines running for more than one 11 hour if the train is stationary within one-half mile of an area 12 zoned for residential purposes in a city. Pursuant to Code 13 section 327D.17, a violation of the bill results in a schedule 14 “four” penalty under Code section 327C.5, which is a fine of 15 not less than $500 nor more than $5,000 per violation. 16 -1- LSB 5177XS (2) 91 th/ns 1/ 1
