S.F. 2013 Section 1. Section 124.204, subsection 4, Code 2026, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . cq. Kratom, meaning any parts of the plant 3 Mitragyna speciosa, whether growing or not, and any compound, 4 manufacture, salt, derivative, mixture, or preparation of 5 that plant, including but not limited to mitragynine and 6 7-hydroxymitragynine. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill designates kratom as a hallucinogenic schedule I 11 controlled substance. 12 A person possessing kratom is guilty of a serious 13 misdemeanor for a first offense. A person who commits a 14 subsequent violation is guilty of an aggravated misdemeanor. 15 A person who has previously been convicted two or more times 16 is guilty of a class “D” felony. A serious misdemeanor is 17 punishable by confinement for no more than one year and a fine 18 of at least $430 but not more than $2,560. An aggravated 19 misdemeanor is punishable by confinement for no more than two 20 years and a fine of at least $855 but not more than $8,540.
