S.F. 2010 Section 1. Section 282.18, subsection 10, paragraph b, 1 subparagraph (1), Code 2026, is amended to read as follows: 2 (1) A receiving district with a total enrollment of less 3 than two thousand students may send school vehicles not more 4 than two miles into the district of residence of the pupil 5 using the open enrollment option under this section , for the 6 purpose of transporting the pupil to and from school in the 7 receiving district, if the pupil’s primary residence is closer 8 to the attendance center the pupil attends in the receiving 9 district than the residence is to the attendance center the 10 pupil would be assigned in the sending district. 11 Sec. 2. Section 282.18, subsection 10, paragraph b, 12 subparagraph (2), unnumbered paragraph 1, Code 2026, is amended 13 to read as follows: 14 Notwithstanding subparagraph (1), a receiving district with 15 a total enrollment of greater than or equal to two thousand 16 students may send school vehicles two miles or more into the 17 district of residence of the pupil using the open enrollment 18 option under this section , for the purpose of transporting the 19 pupil to and from school in the receiving district, regardless 20 of the distance between the pupil’s primary residence and the 21 attendance center the pupil attends in the receiving district 22 or the attendance center the pupil would be assigned in the 23 sending district, if all of the following apply: 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill relates to the transportation to and from school 28 of pupils participating in open enrollment. Current law 29 provides that a receiving district with a total enrollment of 30 less than 2,000 students may send school vehicles not more 31 than two miles into the district of residence of a pupil who 32 open enrolls if the pupil’s primary residence is closer to the 33 attendance center the pupil attends in the receiving district 34 than the residence is to the attendance center the pupil 35 -1- LSB 5093XS (6) 91 jda/jh 1/ 3

The bill modifies 1 this provision to strike the requirement related to distance 2 traveled, authorizing such a receiving district to send school 3 vehicles into the district of residence of a pupil who open 4 enrolls if the pupil’s primary residence is closer to the 5 attendance center the pupil attends in the receiving district 6 than the residence is to the attendance center the pupil would 7 be assigned in the sending district. 8 Current law also provides that a receiving district with a 9 total enrollment of at least 2,000 students may send school 10 vehicles two miles or more into the district of residence of 11 a pupil who open enrolls, regardless of the distance between 12 the pupil’s primary residence and the attendance center the 13 pupil attends in the receiving district or the attendance 14 center the pupil would be assigned in the sending district, if 15 the total enrollment of the pupil’s district of residence is 16 less than 2,000 students, the pupil’s district of residence is 17 contiguous to the receiving district, and the pupil’s district 18 of residence has sent school vehicles into the receiving 19 district. The bill modifies this provision to strike the 20 requirement related to distance traveled, authorizing such a 21 receiving school district to send school vehicles into the 22 district of residence of a pupil who open enrolls, regardless 23 of the distance between the pupil’s primary residence and the 24 attendance center the pupil attends in the receiving district 25 or the attendance center the pupil would be assigned in the 26 sending district, if the total enrollment of the pupil’s 27 district of residence is less than 2,000 students, the pupil’s 28 district of residence is contiguous to the receiving district, 29 and the pupil’s district of residence has sent school vehicles 30 into the receiving district. 31 Current law authorizes a receiving district to send school 32 vehicles into the district of residence of a pupil who open 33 enrolls, regardless of the distance between the pupil’s primary 34 residence and the attendance center the pupil attends in the 35 -2- LSB 5093XS (6) 91 jda/jh 2/ 3
