H.F. _____ Section 1. NEW SECTION . 328.17 Prohibited use of automatic 1 dependent surveillance-broadcast data. 2 1. A person shall not collect or use data broadcast by 3 automatic dependent surveillance-broadcast to calculate, 4 generate, impose, or collect fees associated with the operation 5 of aircraft within this state. 6 2. For purposes of this section, “automatic dependent 7 surveillance-broadcast” means an advanced aviation surveillance 8 technology that combines ground infrastructure, aircraft 9 avionics, and an aircraft’s positioning source to create an 10 accurate surveillance interface between an aircraft and air 11 traffic control and includes two different services: one 12 that receives data relating to aircraft, weather, and traffic 13 information from ground stations, and the other that broadcasts 14 an aircraft’s global positioning system location, altitude, 15 ground speed, and other data. 16 Sec. 2. EFFECTIVE DATE. This Act takes effect November 1, 17 2026. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill prohibits a person from collecting or using data 22 broadcast by automatic dependent surveillance-broadcast (ADS-B) 23 to calculate, generate, impose, or collect fees associated with 24 the operation of aircraft within Iowa. The bill defines ADS-B 25 for purposes of the bill. Generally, ADS-B is an aviation 26 surveillance technology and form of electronic conspicuity 27 in which an aircraft determines its position via satellite 28 navigation or other sensors and periodically broadcasts its 29 position and other related data, enabling it to be tracked. 30 By operation of law, a person who violates the bill is guilty 31 of a fraudulent practice under Code sections 714.8 through 32 714.14, as applicable. A fraudulent practice is punishable 33 based on the amount of money or value involved, and ranges from 34 a simple misdemeanor punishable by confinement for no more than 35 -1- LSB 6879YC (3) 91 th/ns 1/ 2
