Section 455C.1, subsection 1, Code 2026, is 1 amended to read as follows: 2 1. “Beverage” means wine as defined in section 123.3, 3 subsection 53 , alcoholic liquor as defined in section 123.3, 4 subsection 4 , beer as defined in section 123.3, subsection 5 6 , high alcoholic content beer as defined in section 123.3, 6 subsection 22 , canned cocktail as defined in section 123.3, 7 subsection 10 , mineral water, soda water, and similar 8 carbonated soft drinks in liquid form and intended for human 9 consumption. “Beverage” also means a similar noncarbonated 10 soft drink that is packaged in a metal can, in liquid form, and 11 intended for human consumption. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill relates to the definition of “beverage” for 16 purposes of Code chapter 455C, commonly referred to as the 17 bottle bill. 18 The bill expands the definition of “beverage” to include 19 a noncarbonated soft drink that is similar to other included 20 beverages, packaged in a metal can, in liquid form, and 21 intended for human consumption. The expanded definition 22 requires beverage containers that are metal cans containing 23 noncarbonated soft drinks that are similar to other beverages, 24 in liquid form, and intended for human consumption to indicate 25 and be redeemable for the refund value provided in Code section 26 455C.2. 27 -1- LSB 6032YC (2) 91 sb/js 1/ 1
