H.F. _____ Section 1. Section 148.3, subsection 1, unnumbered 1 paragraph 1, Code 2026, is amended to read as follows: 2 An applicant for a license to practice medicine and surgery 3 or osteopathic medicine and surgery , or the applicant’s 4 designee, shall present to the board all of the following: 5 Sec. 2. Section 148.3, Code 2026, is amended by adding the 6 following new subsections: 7 NEW SUBSECTION . 5. The board shall adopt rules pursuant to 8 chapter 17A to set the term of a license to practice medicine 9 and surgery or osteopathic medicine and surgery, but shall not 10 require a license to be renewed more often than once every 11 three years. A license to practice medicine and surgery or 12 osteopathic medicine and surgery shall expire on the licensee’s 13 birthday. 14 NEW SUBSECTION . 6. The board shall not require a licensee 15 to complete more than fifteen hours of continuing education 16 credits per calendar year to maintain a license to practice 17 medicine and surgery or osteopathic medicine and surgery. 18 NEW SUBSECTION . 7. The board shall issue a final decision 19 of an application for a license to practice medicine and 20 surgery or osteopathic medicine and surgery within forty-five 21 calendar days of receipt of the application, unless the board 22 notifies the applicant, and, if applicable, the applicant’s 23 employer, of specific concerns that are delaying the final 24 review of the application. In no event shall the board fail to 25 issue a final decision on an application within seventy-five 26 calendar days of receipt of all necessary documentation from 27 the applicant or the applicant’s designee. 28 Sec. 3. Section 148.11A, subsection 2, Code 2026, is amended 29 to read as follows: 30 2. a. An application for an administrative medicine license 31 shall be made to the board. An applicant for an administrative 32 medicine license shall meet all of the requirements established 33 in section 148.3 and any additional requirements established by 34 the board by rule. H.F. _____ the initial issuance and renewal of administrative medicine 1 licenses and establishing fees therefor. All license and 2 renewal fees shall be paid to the board. 3 b. The board shall adopt rules pursuant to chapter 17A 4 to set the term of an administrative medicine license, but 5 shall not require an administrative license to be renewed more 6 often than once every three years. An administrative medicine 7 license shall expire on the licensee’s birthday. 8 c. The board shall not require a licensee to complete more 9 than fifteen hours of continuing education credits per calendar 10 year to maintain an administrative medicine license. 11 d. The board shall issue a final decision on an application 12 for an administrative medicine license within forty-five 13 calendar days of receipt of the application, unless the board 14 notifies the applicant and, if applicable, the applicant’s 15 employer, of specific concerns that are delaying the final 16 review of the application. In no event shall the board fail to 17 issue a final decision on an application within seventy-five 18 calendar days of receipt of all necessary documentation from 19 the applicant or the applicant’s designee. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill relates to licenses to practice medicine and 24 surgery or osteopathic medicine and surgery, and administrative 25 medicine licenses (license). The bill allows an applicant for 26 a license to designate a person to submit application materials 27 on the applicant’s behalf. The bill requires the board of 28 medicine (board) to adopt rules setting the term of a license 29 at not less than three years, and requires a license to expire 30 on the birthday of a licensee. The bill prohibits the board 31 from requiring a person to complete more than 15 hours of 32 continuing education credits per year to maintain a license. 33 The bill requires the board to issue a final decision on an 34 application for a license within 45 calendar days of receipt 35 -2- LSB 5714YC (1) 91 ss/ko 2/ 3
