Section
310.18,
Code
2025,
is
amended
to
read
as

follows:

310.18
Partial
payments
during
construction.
3
Partial
payments
may
be
made
on
work
in
progress,
but
no
4
such
partial
payment
shall
not
be
deemed
final
acceptance
of
5
the
work
nor
a
waiver
of
any
defect
in
the
work.
The
board
of
6
supervisors,
the
county
engineer,
or
the
department
may
approve
7
partial
and
final
claims.
Approval
may
be
evidenced
by
the
8
signature
of
the
county
engineer
or
chairperson
of
the
board
9
or
department,
or
a
majority
of
the
members
of
the
board
or
10
department,
on
the
individual
claims
or
on
the
abstract
of
a
11
number
of
claims
with
the
individual
claims
attached
to
the
12
abstract.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
15
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
all
claims
for
improving
farm-to-market
17
roads
must
be
paid
from
the
farm-to-market
road
fund
and
18
charged
to
the
allotment
of
the
fund
for
the
county
in
which
19
the
project
is
located.
Partial
payments
may
be
made
on
20
work
in
progress,
and
a
partial
payment
is
not
deemed
final
21
acceptance
of
the
work
or
a
waiver
of
any
defect
in
the
work.

The
board
of
supervisors
of
a
county,
the
county
engineer,
or
23
the
department
of
transportation
(DOT)
may
approve
claims.
24
This
bill
specifies
that
the
board
of
supervisors
of
a
25
county,
the
county
engineer,
or
the
DOT
may
approve
partial
and
26
final
claims
for
partial
payments
made
during
construction
of
27
a
farm-to-market
road.
