SECTION
.
321H.3A
Education
program
required
1
for
certain
recyclers.
2
1.
Beginning
January
1,
2027,
a
person
shall
not
recycle
3
battery
electric
motor
vehicles
or
plug-in
hybrid
electric
4
motor
vehicles,
as
those
terms
are
defined
in
section
321.116,
5
unless
the
person
is
an
authorized
vehicle
recycler
who
6
has
successfully
completed
a
vehicle
high-voltage
battery
7
safe
handling
and
storage
education
program
approved
by
the
8
department.
An
authorized
vehicle
recycler
shall
display
a
9
program
completion
certificate
next
to
the
recycler’s
license
10
displayed
as
required
by
section
321H.5.

2.
The
department
shall
approve
vehicle
high-voltage
12
battery
safe
handling
and
storage
education
programs
and
such
13
programs
shall
award
a
program
completion
certificate
to
an
14
authorized
vehicle
recycler
who
successfully
completes
the
15
program.

agreement
with

the
members
of
the
general
assembly.

Under
current
law,
a
person
must
be
licensed
by
the
20
department
of
transportation
(DOT)
as
an
authorized
vehicle
21
recycler
to,
with
respect
to
vehicles
required
to
be
22
registered,
sell
certain
used
parts
of
more
than
six
used
23
vehicles;
dismantle,
scrap,
recycle,
or
salvage
more
than
24
six
vehicles;
or
rebuild
or
restore
for
sale
more
than
six
25
wrecked
or
salvage
vehicles
in
a
12-month
period;
or
with
26
respect
to
vehicles
not
currently
registered,
store
more
than
27
six
vehicles
or
store
damaged
vehicles
except
where
such
28
storage
is
incidental
to
the
primary
purpose
of
the
repair
of
29
vehicles
for
others.
The
licensing
requirement
does
not
apply
30
to
persons
who
are
educational
institutions,
licensed
as
new
31
vehicle
dealers,
engaged
in
a
hobby
not
for
profit,
engaged
32
in
the
business
of
purchasing
certain
parts
of
vehicles
only
33
for
sale
as
scrap
metal,
insurance
companies,
county
mutual
34
insurance
associations,
or
state
mutual
insurance
associations.

A
license
issued
to
a
person
must
be
conspicuously
displayed
at
1
the
person’s
principal
place
of
business
except
during
periods
2
when
the
license
is
surrendered
for
modifications.

This
bill
prohibits
a
person,
beginning
January
1,
2027,
4
from
recycling
battery
electric
motor
vehicles
or
plug-in
5
hybrid
electric
motor
vehicles
unless
the
person
is
an
6
authorized
vehicle
recycler
who
has
successfully
completed
7
a
vehicle
high-voltage
battery
safe
handling
and
storage
8
education
program
approved
by
the
DOT
and
displays
a
program
9
completion
certificate
next
to
the
recycler’s
license.
The
10
DOT
is
required
to
approve
such
programs,
which
must
award
11
a
program
completion
certificate
to
an
authorized
vehicle
12
recycler
who
successfully
completes
the
program.
13
“Battery
electric
motor
vehicle”
means
a
motor
vehicle
14
equipped
with
electrical
drivetrain
components
and
not
15
equipped
with
an
internal
combustion
engine,
that
is
propelled
16
exclusively
by
one
or
more
electrical
motors
using
electrical
17
energy
stored
in
a
battery
or
other
energy
storage
device
that
18
can
be
recharged
by
plugging
into
an
electrical
outlet
or
19
electric
vehicle
charging
station.
“Plug-in
hybrid
electric
20
motor
vehicle”
means
a
motor
vehicle
equipped
with
electrical
21
drivetrain
components,
an
internal
combustion
engine,
and
a
22
battery
or
other
energy
storage
device
that
can
be
recharged
by
23
plugging
into
an
electrical
outlet
or
electric
vehicle
charging
24
station.

By
operation
of
law,
a
person
convicted
of
violating
the
bill
26
is
guilty
of
a
serious
misdemeanor.
A
serious
misdemeanor
is
27
punishable
by
confinement
for
no
more
than
one
year
and
a
fine
28
of
at
least
$430
but
not
more
than
$2,560.
