H.F. 959 Section 1. VENTILATOR-DEPENDENT RECIPIENTS —— SERVICES 1 UNDER MEDICAL ASSISTANCE PROGRAM. The department of health and 2 human services shall adopt rules pursuant to chapter 17A for 3 purposes of the medical assistance program that do all of the 4 following: 5 1. Require ventilator services to be provided to a 6 ventilator-dependent recipient based on need and not on the 7 recipient’s age. 8 2. Permit any qualified provider to provide services to a 9 ventilator-dependent recipient. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill requires the department of health and human 14 services to adopt rules related to ventilator-dependent 15 recipients for purposes of the medical assistance program 16 (Medicaid). The rules shall require ventilator services to 17 be provided to a ventilator-dependent recipient based on the 18 recipient’s need and not on the recipient’s age.
