H.F. 901 Section 1. NEW SECTION . 80B.20 Military veterans with 1 active duty military police experience —— former federal law 2 enforcement officers. 3 1. A veteran may qualify for lateral transfer to a law 4 enforcement agency in this state without completing the academy 5 training program if the veteran meets the following criteria: 6 a. Has served a minimum of four years of active duty in the 7 United States armed forces. 8 b. Has held a primary military occupational specialty or 9 equivalent designation as a military police officer in the 10 army, or its equivalent in other branches. 11 c. Has successfully completed accredited military police 12 training equivalent to or exceeding the academy’s standards. 13 d. Has received an honorable discharge within three years of 14 applying for a lateral transfer. 15 2. A former federal law enforcement officer may qualify 16 for lateral transfer to a law enforcement agency in this state 17 without completing the academy training program if the former 18 federal law enforcement officer meets the following criteria: 19 a. Has served a minimum of four years as a federal law 20 enforcement officer. 21 b. Has successfully completed accredited federal law 22 enforcement training equivalent to or exceeding the academy’s 23 standards. 24 3. An eligible veteran shall submit an application to the 25 council for evaluation. The application shall include all of 26 the following: 27 a. Proof of military service and discharge status. 28 b. Certification of military police training and experience. 29 c. Documentation of relevant duties performed during active 30 duty. 31 4. An eligible federal law enforcement officer shall submit 32 an application to the council for evaluation. The application 33 shall include all of the following: 34 a. H.F. 901 b. Certification of federal law enforcement training and 1 experience. 2 c. Documentation of relevant duties performed during 3 employment as a federal law enforcement officer. 4 5. The council shall review the applications and issue 5 a certificate of equivalency to veterans or former federal 6 law enforcement officers who meet the respective eligibility 7 criteria. 8 6. Veterans or former federal law enforcement officers 9 granted a certificate of equivalency must do all of the 10 following: 11 a. Complete a one-week Iowa-specific law enforcement 12 orientation course administered by the academy, focusing 13 on state laws, procedures, and community policing that is 14 equivalent to the training required of an out-of-state law 15 enforcement officer transferring to a law enforcement agency 16 in this state. 17 b. Undergo any required background checks and psychological 18 evaluations as required for all new law enforcement hires in 19 this state. 20 7. Failure of a veteran or former federal law enforcement 21 officer to become certified within one year of being granted 22 a certificate of equivalency shall void the certificate and 23 would require the veteran or former federal law enforcement 24 officer to resubmit an application for a new certificate of 25 equivalency. 26 8. The council shall develop procedures and guidelines for 27 evaluating military police training and equivalency standards. 28 9. The council shall publish an annual report including 29 data on the number of veterans and former federal law 30 enforcement officers transitioning to state law enforcement 31 and the veterans’ and former federal law enforcement officers’ 32 performance in law enforcement roles. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -2- LSB 2228HV (2) 91 as/js 2/ 4
H.F. 901 the explanation’s substance by the members of the general assembly. 1 This bill relates to the law enforcement academy, including 2 military veterans with active duty military police experience 3 and former federal law enforcement officers. 4 The bill provides that a veteran may qualify for lateral 5 transfer to a law enforcement agency in this state without 6 completing the academy training program if the veteran meets 7 the following criteria: has served a minimum of four years 8 of active duty in the United States armed forces; has held 9 a primary military occupational specialty or equivalent 10 designation as a military police officer in the army, or its 11 equivalent in other branches; has successfully completed 12 accredited military police training equivalent to or exceeding 13 the academy’s standards; and has received an honorable 14 discharge within three years of applying for a lateral 15 transfer. 16 The bill provides that a former federal law enforcement 17 officer may qualify for lateral transfer to a law enforcement 18 agency in this state without completing the academy training 19 program if the former federal law enforcement officer has 20 served a minimum of four years as a federal law enforcement 21 officer and has successfully completed accredited federal law 22 enforcement training equivalent to or exceeding the academy’s 23 standards. 24 The bill provides that an eligible veteran is required 25 to submit an application to the council for evaluation that 26 includes all of the following: proof of military service and 27 discharge status; certification of military police training 28 and experience; and documentation of relevant duties performed 29 during active duty. 30 The bill provides that an eligible federal law enforcement 31 officer shall submit an application to the council for 32 evaluation that includes all of the following: proof of 33 employment as a federal law enforcement officer; certification 34 of federal law enforcement training and experience; and 35 -3- LSB 2228HV (2) 91 as/js 3/ 4
