is
amended
to
read
as
follows:

To
attend
duly
scheduled
courses
of
instruction.

However,
a
licensee
who
attends
a
public
school
and
resides
4
within
that
public
school
district
may
operate
a
motor
vehicle
5
between
the
licensee’s
residence
and
school
regardless
of
the
6
distance
,
and
a
licensee
participating
in
open
enrollment
under
7
section
282.18
may
operate
a
motor
vehicle
no
more
than
forty
8
miles
between
the
licensee’s
residence
and
school
.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
a
person
between
the
ages
of
14
and
18
13
years
who
holds
a
special
minor’s
restricted
license
(licensee)
14
is
authorized
to
operate
a
motor
vehicle
without
supervision
15
between
certain
approved
locations
for
a
number
of
purposes
16
during
specified
times,
including
to
attend
duly
scheduled
17
courses
of
instruction
regardless
of
whether
the
licensee
is
18
receiving
competent
private
instruction
or
independent
private
19
instruction,
or
is
enrolled
in
a
public
school
or
accredited
20
nonpublic
school.
A
licensee
is
authorized
to
operate
a
motor
21
vehicle
during
the
hour
before
and
after
the
beginning
and
22
end
of
the
licensee’s
duly
scheduled
courses
of
instruction.

The
driving
distance
between
the
point
of
origin
and
the
24
destination
cannot
exceed
25
miles,
unless
the
licensee
attends
25
a
public
school
and
resides
within
that
public
school
district,
26
in
which
case
the
licensee
may
operate
a
motor
vehicle
between
27
the
licensee’s
residence
and
school
regardless
of
the
distance.

This
bill
authorizes
a
licensee
participating
in
open
29
enrollment
to
operate
a
motor
vehicle
no
more
than
40
miles,
30
rather
than
25
miles,
between
the
licensee’s
residence
and
31
school.
32
A
licensee
who
violates
the
restrictions
of
a
special
33
minor’s
restricted
license
commits
a
simple
misdemeanor,
34
classified
as
a
moving
violation,
punishable
by
a
$70
scheduled

fine.
Additionally,
the
department
of
transportation
must
1
suspend
the
license
for
three
months
and
is
prohibited
from
2
issuing
an
intermediate
license
to
the
person
for
an
additional
3
three
months
following
the
person’s
sixteenth
birthday.
