H.F. 881 Section 1. Section 455B.392, subsection 1, paragraph a, 1 Code 2025, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (5) The excessive and extraordinary 3 costs incurred by the state or its political subdivisions or 4 the agents of the state or a political subdivision for the 5 oversight and monitoring of a hazardous condition caused by 6 that person. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 Current law imposes strict liability on a person having 11 control over a hazardous substance for certain costs. This 12 bill imposes strict liability on a person having control over a 13 hazardous substance for excessive and extraordinary oversight 14 and monitoring costs expended by the state or political 15 subdivision related to hazardous conditions created by that 16 person. 17 -1- LSB 1456HV (2) 91 sb/js 1/ 1
