H.F. 817 Section 1. Section 633.356, subsection 3, Code 2025, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . c. Child support services, as created 3 in section 252B.2, shall make available a form meeting 4 the requirements of this subsection that may be used, if 5 appropriate, by a successor as defined in subsection 2, 6 paragraph “a” or “b” , when child support services or the 7 collection services center, as created in section 252B.13A, 8 is the holder of the decedent’s property in the form of 9 undistributed child support owed to the decedent. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 Current law allows for the distribution of a decedent’s 14 property by affidavit for very small estates (those with 15 a gross value of $50,000 or less). This bill allows a 16 successor of a decedent who has a very small estate to access 17 undistributed child support payments owed to the decedent held 18 by child support services or the collection services center. 19 The bill requires child support services to create and make 20 available a form that allows the successor to collect the held 21 moneys. 22 -1- LSB 2621YH (2) 91 cm/jh 1/ 1
