Minors’
use
of
tanning
1
devices
——
restrictions.

1.
A
tanning
facility
shall
not
allow
a
person
under
sixteen
3
years
of
age
to
use
a
tanning
device.

2.
a.
A
tanning
facility
shall
not
allow
a
person
who
5
is
sixteen
or
seventeen
years
of
age
to
use
a
tanning
device
6
unless
all
of
the
following
apply:

(1)
The
parent
or
guardian
of
the
person
is
present
at
the
8
tanning
facility.
9
(2)
The
parent
or
guardian
of
the
person
provides
written
10
consent
for
the
person
to
use
a
tanning
device,
which
must
11
include
the
following
statement:
12
UV
tanning
devices
increase
the
risk
of
melanoma,
a
13
particularly
deadly
type
of
skin
cancer.
UV
radiation
is
most
14
dangerous
when
exposed
at
a
young
age.
15
b.
A
written
consent
provided
pursuant
to
paragraph
“a”
,
16
subparagraph
(2),
shall
remain
valid
for
subsequent
visits
to
17
the
tanning
facility.
However,
the
written
consent
may
be
18
revoked
at
any
time
by
the
parent
or
guardian
who
provided
it.

EXPLANATION
20
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
21
the
explanation’s
substance
by
the
members
of
the
general
assembly.
22
This
bill
prohibits
a
tanning
facility
from
allowing
a
23
person
under
16
years
of
age
to
use
a
tanning
device.
The
bill
24
also
prohibits
a
tanning
facility
from
allowing
a
person
who
is
25
16
or
17
years
of
age
to
use
a
tanning
device
unless
the
parent
26
or
guardian
of
the
person
is
present
and
provides
written
27
consent,
which
must
include
a
statement
about
the
danger
of
UV
28
tanning
devices.
A
written
consent
remains
valid
for
future
29
visits
but
may
be
revoked
at
any
time
by
the
parent
or
guardian
30
who
provided
it.
By
operation
of
law,
a
person
who
violates
31
the
bill
is
subject
to
enforcement
actions
by
the
department
32
of
inspections,
appeals,
and
licensing,
including
a
civil
33
penalty
not
to
exceed
$1,000
and
an
injunction
restraining
any
34
violation.
