Section
1.
NEW
SECTION
.
533C.1004
Wire
transmission
fees.
1
1.
For
purposes
of
this
section,
“wire
transmission”
means
2
money
transmission
by
wire
to
or
from
locations
abroad.

2.
In
addition
to
any
other
fee
required
by
law
for
a
wire
4
transmission,
a
licensee
or
the
licensee’s
authorized
delegate
5
shall
collect
from
a
customer
a
fee
of
five
dollars
for
each
6
wire
transmission
equal
to
or
less
than
five
hundred
dollars,
7
and
in
addition
to
such
fee,
if
applicable,
an
amount
equal
to
8
two
percent
of
the
amount
of
the
wire
transmission
in
excess
9
of
five
hundred
dollars.

3.
The
fees
collected
under
subsection
2
shall
be
remitted
11
quarterly
by
the
licensee
or
the
licensee’s
authorized
12
delegate
to
the
department
of
revenue
in
the
form
and
manner
13
prescribed
by
the
department
of
revenue,
in
consultation
with
14
the
department
of
public
safety.
All
required
forms
and
15
remittances
shall
be
filed
with
the
department
of
revenue
no
16
later
than
the
fifteenth
day
of
the
month
following
the
close
17
of
each
calendar
quarter.

The
department
of
revenue
shall
account
for
all
fees
19
remitted
under
subsection
3
and
pay
ten
percent
of
the
same
to
20
the
office
to
combat
human
trafficking
established
in
section
21
80.45,
and
deposit
the
remainder
in
the
general
fund
of
the
22
state.

5.
a.
The
department
of
revenue,
in
consultation
with
the
24
department
of
public
safety,
shall
enforce
the
provisions
of
25
this
section.

b.
If
a
licensee
or
licensee’s
authorized
delegate
fails
27
to
comply
with
subsection
3,
the
department
of
revenue
shall
28
notify
the
superintendent
who
may
suspend
or
revoke
the
29
licensee’s
license
under
section
533C.901,
and
may
issue
an
30
order
suspending
or
revoking
the
designation
of
an
authorized
31
delegate
under
section
533C.902.
Notification
of
a
suspension
32
under
this
paragraph
shall
be
delivered
to
the
commissioner
of
33
public
safety.

Upon
request
by
the
department
of
revenue,
the

superintendent
may
file
a
claim
against
the
surety
bond
of
the
1
licensee
on
behalf
of
the
state.

This
bill
relates
to
fees
for
wire
transmissions
and
related
6
income
tax
credits.
7
Under
the
bill,
in
addition
to
any
other
fee
required
by
8
law
for
a
wire
transmission,
a
licensee
or
the
licensee’s
9
authorized
delegate
shall
collect
a
fee
of
$5
for
each
wire
10
transmission
equal
to
or
less
than
$500,
and
an
additional
fee
11
equal
to
2
percent
of
any
amount
in
excess
of
$500.
“Wire
12
transmission”
is
defined
in
the
bill.
13
The
fees
shall
be
remitted
by
the
licensee
quarterly
14
to
the
department
of
revenue
(department)
in
the
form
and
15
manner
prescribed
by
the
department
in
consultation
with
16
the
department
of
public
safety.
All
required
forms
and
17
remittances
shall
be
filed
with
the
department
no
later
than
18
the
15th
day
of
the
month
following
the
close
of
each
calendar
19
quarter.
The
department
shall
account
for
all
fees
remitted
20
and
pay
10
percent
of
the
same
to
the
office
to
combat
human
21
trafficking,
and
deposit
the
remainder
in
the
general
fund

the
state.

The
department,
in
consultation
with
the
department
of
24
public
safety,
shall

bill.
If
a

licensee
fails
to

the
bill,
the
department
shall

the
superintendent
of
banking
who
may
suspend
or
revoke
27
the
licensee’s
license,
and
may
issue
an
order
suspending
28
or
revoking
the
designation
of
an
authorized
delegate.
29
Notification
of
a
suspension
shall
be
delivered
to
the
30
commissioner
of
public
safety.
Upon
request
by
the
department,
31
the
superintendent
may
file
a
claim
against
the
surety
bond
of
32
the
licensee
on
behalf
of
the
state.
