H.F. 2633 Section 1. NEW SECTION . 511.41 Living organ donors. 1 1. As used in this section, unless the context otherwise 2 requires: 3 a. “Covered person” means a policyholder, subscriber, 4 enrollee, or other individual participating in a policy. 5 b. “Insurer” means a company qualified and licensed by the 6 insurance division to transact the business of insurance in 7 this state by certificate issued pursuant to chapter 508, 514, 8 514A, 514B, or 514E. 9 c. “Living organ donor” means an individual who is not 10 deceased and who has donated all or part of an organ. 11 d. “Policy” means a life insurance policy, disability 12 insurance policy, or long-term care insurance policy. 13 2. An insurer shall not, based solely on an individual’s 14 status as a living organ donor, do any of the following: 15 a. Decline or limit coverage under a policy for a covered 16 person that is a living organ donor. 17 b. As a condition of continued coverage under a policy, 18 preclude a covered person from becoming a living organ donor. 19 c. Discriminate against a covered person or individual in 20 the offering, issuance, cancellation, coverage amount, price, 21 or any other condition of a policy on the sole basis that the 22 covered person or individual is a living organ donor. 23 3. The commissioner of insurance may adopt rules pursuant to 24 chapter 17A to administer this section. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill relates to insurance requirements applicable to 29 living organ donors. 30 The bill defines “policy” as a life insurance policy, 31 disability insurance policy, or long-term care insurance 32 policy. A “living organ donor” (donor) is defined as an 33 individual who is not deceased and who has donated all or part 34 of an organ. 35 -1- LSB 5385HV (2) 91 nls/ko 1/ 2
