H.F. 257 Section 1. Section 321I.10, subsection 4, Code 2025, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . c. A county shall not charge a fee to 3 operate a registered all-terrain vehicle or off-road utility 4 vehicle on secondary roads within the county. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 Under current law, a registered all-terrain vehicle (ATV) 9 or off-road utility vehicle (UTV) may be operated on specified 10 types of secondary roads (e.g., unpaved roads, paved roads over 11 certain routes, and other paved roads if authorized by the 12 county). However, a county may prohibit the operation of ATVs 13 and UTVs on a secondary road or segment thereof under certain 14 circumstances (e.g., when closed to traffic, designated as a 15 detour route, or by ordinance for limited periods). 16 This bill prohibits a county from charging a fee to operate a 17 registered ATV or UTV on secondary roads within the county.
