H.F. 2558 Section 1. Section 26.2, subsection 3, paragraph b, Code 1 2026, is amended by adding the following new subparagraphs: 2 NEW SUBPARAGRAPH . (7) Equipment acquired by or for a city 3 utility under chapter 388 when such equipment is related to an 4 electric generating project. 5 NEW SUBPARAGRAPH . (8) The furnishing of a manufactured 6 home, as defined in section 435.1, as well as all work 7 necessary to install the home in accordance with 24 C.F.R. 8 pt. 3285, including but not limited to the erection of the 9 foundation or tiedown system, supporting, anchoring, and 10 close-up of the home, and implementing the utility service 11 connections for the home. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill revises the definition of “public improvement” 16 for purposes of Code chapter 26 (public construction bidding) 17 to exclude equipment acquired by or for a city utility 18 under Code chapter 388 when such equipment is related to an 19 electric generating project and to exclude the furnishing of 20 a manufactured home, including the erection of the foundation 21 or tiedown system, supporting, anchoring, and close-up of the 22 home, and implementing the utility service connections for the 23 home. 24 By operation of law, the bill affects the term “public 25 improvement” as used in Code chapter 26A (guaranteed maximum 26 price contracts) and in Code sections 8.46 (lease-purchase 27 reporting); 260C.38 (community college lease-purchase 28 contracts); 278.1 (school district lease-purchase contracts); 29 297.7 (construction, renovation, and repair of school 30 buildings); 298.3 (school district levy revenue); 331.341 31 (county board of supervisors contracts); 364.4 (city 32 lease-purchase contracts); and 384.20 (city finance accounts). 33 -1- LSB 5851HV (2) 91 sc/js 1/ 1
