H.F. 2515 Section 1. Section 907.3, subsection 2, paragraph a, Code 1 2026, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (10) The offense is a violation of 3 section 728.12 and the minor at the time of the offense was 4 under twelve years of age or prepubescent. 5 Sec. 2. Section 907.3, subsection 3, Code 2026, is amended 6 by adding the following new paragraph: 7 NEW PARAGRAPH . i. The offense is a violation of section 8 728.12 and the minor at the time of the offense was under 9 twelve years of age or prepubescent. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill relates to sexual exploitation of a minor and 14 deferred and suspended sentences. 15 The bill provides that a person convicted of sexual 16 exploitation of a child in violation of Code section 728.12 is 17 not eligible to receive a deferred or suspended sentence if the 18 minor at the time of the offense was under 12 years of age or 19 prepubescent. 20 -1- LSB 5938HV (1) 91 as/js 1/ 1
