H.F. 2292 Section 1. DEPARTMENT OF HEALTH AND HUMAN SERVICES —— STATE 1 MENTAL HEALTH INSTITUTE INPATIENT PSYCHIATRIC BEDS. By July 1, 2 2027, the department of health and human services shall, at a 3 minimum, double the number of inpatient psychiatric beds based 4 on the number of inpatient psychiatric beds that were at each 5 state mental health institute on June 30, 2025. No later than 6 October 1, 2026, the department of health and human services 7 shall apply to the centers for Medicare and Medicaid services 8 of the United States department of health and human services 9 for a waiver of Medicaid’s institution for mental diseases 10 exclusion. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill directs the department of health and human 15 services (HHS), by July 1, 2027, to at least double the number 16 of inpatient psychiatric beds (beds) based on the number of 17 beds that were at each state mental health institute (MHI) on 18 June 30, 2025. The bill requires HHS, by October 1, 2026, 19 to apply to the centers for Medicare and Medicaid services 20 of the United States department of health and human services 21 for a waiver of Medicaid’s institution for mental diseases 22 exclusion so the state may use Medicaid funds for the increase 23 in inpatient psychiatric beds. 24 -1- LSB 5437HV (1) 91 dg/ko 1/ 1
