H.F. 216 Section 1. DEPARTMENT OF HEALTH AND HUMAN SERVICES —— CHILD 1 CARE CENTERS —— LIABILITY INSURANCE. The department of health 2 and human services shall promulgate rules pursuant to chapter 3 17A to require a child care center that employs a person under 4 the age of eighteen who provides child care or substitute child 5 care to school-age children without additional supervision 6 to provide documentation to the department of professional 7 liability insurance coverage for such employees. For the 8 purposes of this section, “child care” and “child care center” 9 mean the same as defined in section 237A.1. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill relates to professional liability insurance by 14 child care centers employing unsupervised child care workers 15 under 18 years of age. 16 The bill requires the department of health and human 17 services to promulgate rules to require a child care center 18 that employs a person under 18 years of age who provides 19 child care or substitute child care to school-age children 20 without additional supervision to provide documentation to the 21 department of professional liability insurance coverage for 22 such employees.
