Section
123.130,
subsection
3,
Code

is

to
read
as
follows:

premises
shall
be
located
within
the
state.

beer
received
by
the
holder
of
a
class
“A”
beer
permit
from

holder
of
a
certificate
of
compliance
before
being
resold

must
first
come
to
rest
on
the
licensed
premises
of
the
permit

holder,
must
be
inventoried,
and
is
subject
to
the
barrel
tax

when
resold
as
provided
in
section
123.136

beer

permittee
shall
not
store
beer
overnight
except
on

licensed

1.
A
native
brewery
holding
a
class
“A”
beer
permit
may

apply
for
a
temporary
class
“A”
beer
permit
under
this
section.

2.
A
native
brewery
shall
submit
an
application
for
16
a
temporary
permit
under
this
section
to
the
department
17
electronically,
or
in
a
manner
prescribed
by
the
director,
for
18
each
off-premises
site
the
native
brewery
intends
to
use
as
19
described
in
subsection
4.
20
3.
Except
as
otherwise
provided
in
this
section,
the
21
requirements
of
a
temporary
class
“A”
beer
permit
are
the
same
22
as
a
class
“A”
beer
permit.

4.
A
person
holding
a
temporary
class
“A”
beer
permit
may,
24
on
a
temporary
basis
for
a
period
not
to
exceed
nine
months,
25
manufacture
beer
off
premises
using
the
person’s
own
equipment
26
or
store
beer
overnight
off
premises.
A
temporary
class
“A”
27
beer
permit
does
not
authorize
a
person
to
sell
beer
at
the
28
off-premises
location.

The
fee
for
a
temporary
permit
issued
pursuant
to
this
30
section
is
one-half
of
the
annual
permit
fee
the
holder
paid
31
pursuant
to
section
123.134,
subsection
2.

6.
A
refund
of
fees
paid
shall
not
be
made
for
a
temporary
33
license
issued
pursuant
to
this
section.
A
temporary
permit
34
issued
pursuant
to
this
section
is
renewable
up
to
two
times.

This
bill
creates
temporary
class
“A”
beer
permits
4
authorizing
native
breweries
to
manufacture
and
store
beer
off
5
premises.
A
“native
brewery”
is
a
business
which
manufactures
6
beer
or
high
alcoholic
content
beer
and
is
operated
by
a
person
7
who
holds
a
class
“A”
beer
permit.
8
Currently,
a
person
holding
a
class
“A”
beer
permit
or
9
special
class
“A”
beer
permit
is
not
permitted
to
manufacture
10
or
store
beer
off
premises.
However,
a
person
holding
a
class
11
“A”
or
special
class
“A”
beer
permit
may
manufacture
beer
off
12
premises
using
the
space
and
equipment
of
another
permitted
13
manufacturer
for
the
purpose
of
manufacturing
beer,
provided
14
the
alternating
proprietorship
arrangement
has
been
approved
15
by
the
federal
alcohol
and
tobacco
tax
and
trade
bureau
of
the
16
United
States
department
of
the
treasury.

The
bill
allows
a
native
brewery
holding
a
class
“A”
beer
18
permit
to
apply
for
a
temporary
class
“A”
beer
permit
with
the
19
department
of
revenue.
20
The
bill
permits
a
person
holding
a
temporary
class
“A”
beer
21
permit
to,
on
a
temporary
basis
for
a
period
not
to
exceed
nine
22
months,
manufacture
beer
off
premises
using
the
person’s
own
23
equipment
or
store
beer
overnight
off
premises.
A
temporary
24
permit
under
the
bill
does
not
authorize
the
sale
of
beer
off
25
premises.

The
fee
for
a
temporary
class
“A”
beer
permit
is
$150
27
(one-half
of
the
annual
permit
fee
the
holder
paid
pursuant
to
28
Code
section
123.134(2)).
29
The
bill
prohibits
a
refund
of
the
fees
paid
for
a
temporary
30
permit,
and
the
temporary
permit
is
renewable
up
to
two
times.
