H.F. 164 Section 1. Section 1.2, Code 2025, is amended to read as 1 follows: 2 1.2 Sovereignty. 3 The state possesses sovereignty coextensive with the 4 boundaries referred to in section 1.1 , subject to such rights 5 as may at any time exist in the United States in relation to 6 public lands, or to any military or naval establishment of the 7 national government . 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 Under current law, state sovereignty is subject to the 12 United States’ rights to public lands or to an establishment 13 of the national government. This bill modifies the limits of 14 state sovereignty to make state sovereignty subject only to the 15 United States’ rights to public lands or to military and naval 16 establishments. 17 -1- LSB 2054HH (2) 91 sc/ns 1/ 1
