4,
Code
2025,
is

amended
by
adding
the
following
new
paragraph:

c.
A
county
shall
not
charge
a
fee
to

operate
a
registered
all-terrain
vehicle
or
off-road
utility
4
vehicle
on
secondary
roads
within
the
county.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
a
registered
all-terrain
vehicle
(ATV)
9
or
off-road
utility
vehicle
(UTV)
may
be
operated
on
specified
10
types
of
secondary
roads
(e.g.,
unpaved
roads,
paved
roads
over
11
certain
routes,
and
other
paved
roads
if
authorized
by
the
12
county).
However,
a
county
may
prohibit
the
operation
of
ATVs
13
and
UTVs
on
a
secondary
road
or
segment
thereof
under
certain
14
circumstances
(e.g.,
when
closed
to
traffic,
designated
as
a
15
detour
route,
or
by
ordinance
for
limited
periods).

This
bill
prohibits
a
county
from
charging
a
fee
to
operate
a
17
registered
ATV
or
UTV
on
secondary
roads
within
the
county.
A
18
similar
provision
exists
under
current
law
prohibiting
a
city
19
from
charging
a
fee
to
operate
a
registered
ATV
or
UTV
within
20
the
city.
