is

amended
to
read
as
follows:

(a)
As
allowed
under
42
U.S.C.
§1396a(a)(10)(A)(ii)(XIII),
4
individuals
with
disabilities,
who
are
less
than
sixty-five
5
years
of
age,
who
are
members
of
families
whose
income
is
6
less
than
two
hundred
fifty
percent
of
the
most
recently
7
revised
official
poverty
guidelines
published
by
the
United
8
States
department
of
health
and
human
services
for
the
family,
9
who
have
earned
income
and
who
are
eligible
for
mandatory
10
medical
assistance
or
optional
medical
assistance
under
this
11
section
if
earnings
are
disregarded.
As
allowed
by
42
U.S.C.
12
§1396a(r)(2),
unearned
income
shall
also
be
disregarded
in
13
determining
whether
an
individual
is
eligible
for
assistance
14
under
this
subparagraph.
For
the
purposes
of
determining
the
15
amount
of
an
individual’s
resources
under
this
subparagraph
and
16
as
allowed
by
42
U.S.C.
§1396a(r)(2),
a
maximum
of
ten
thousand
17
dollars
of
available
resources
for
an
individual
and
twenty-one
18
thousand
dollars
of
available
resources
for
a
couple
shall
be
19
disregarded,
and
any
additional
resources
held
in
a
retirement
20
account,
in
a
medical
savings
account,
or
in
any
other
account
21
approved
under
rules
adopted
by
the
department
shall
also
be
22
disregarded.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
Medicaid
for
employed
people
with
27
disabilities
(MEPD)
program.
Currently,
for
the
purposes
28
of
determining
the
resources
of
an
individual
to
meet
the
29
eligibility
requirements
for
the
MEPD
program,
a
maximum
of
30
$10,000
of
available
resources
is
disregarded,
in
addition
31
to
any
additional
resources
held
in
a
retirement
account,
in
32
a
medical
savings
account,
or
in
any
other
account
approved
33
under
rules
adopted
by
the
department
of
health
and
human
34
services
(HHS).
The
bill
maintains
the
maximum
amount
of

provides
that
for
the
