S.F. _____ Section 1. Section 455E.11, subsection 2, paragraph d, 1 unnumbered paragraph 1, Code 2024, is amended to read as 2 follows: 3 A storage tank management account. All The account 4 shall consist of moneys appropriated to, transferred to, or 5 deposited in the account, including fees collected pursuant to 6 section 455B.473, subsection 5 , and section 455B.479 , shall 7 be deposited in the storage tank management account . Moneys 8 deposited in the account shall be expended for all of the 9 following purposes: 10 Sec. 2. Section 455E.11, subsection 2, paragraph d, Code 11 2024, is amended by adding the following new subparagraph: 12 NEW SUBPARAGRAPH . (1A) Moneys transferred under this Act to 13 the account are appropriated for the following purposes: 14 (a) For reimbursement to tank owners for all or part of the 15 costs of a corrective action for a petroleum release. 16 (b) For permanent closure of an underground storage tank 17 system under a remedial program pursuant to section 455G.9, 18 for additional assessment and corrective action arising out of 19 releases at sites for which a certificate of no further action 20 has been issued, and for tank operator training. At least 21 three million dollars of the moneys expended pursuant to this 22 subparagraph shall be expended for this purpose. 23 Sec. 3. Section 455E.11, subsection 2, paragraph d, 24 subparagraph (2), Code 2024, is amended to read as follows: 25 (2) The moneys remaining in the account after the 26 appropriation appropriations in subparagraph subparagraphs (1) 27 and (1A) are appropriated from the storage tank management 28 account to the department of natural resources for the 29 administration of a state storage tank program pursuant to 30 chapter 455B, subchapter IV, part 8 , and for programs which 31 that reduce the potential for harm to the environment and the 32 public health from storage tanks. 33 Sec. 4. TRANSFER OF MONEYS. On the effective date of 34 this Act, all unencumbered and unobligated moneys in the 35 -1- LSB 6274XC (5) 90 lh/js 1/ 2
S.F. _____ Iowa comprehensive petroleum underground storage tank fund 1 created in section 455G.3 are transferred to the storage tank 2 management account of the groundwater protection fund created 3 in section 455E.11. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill relates to the use of moneys in the storage tank 8 management account of the groundwater protection fund that are 9 transferred from the Iowa comprehensive petroleum underground 10 storage tank fund. 11 The groundwater protection fund includes four accounts 12 related to groundwater: the solid waste account, the 13 agriculture management account, the household hazardous waste 14 account, and the storage tank management account. The Iowa 15 comprehensive petroleum underground storage tank fund assists 16 owners and operators of petroleum underground storage tanks in 17 complying with federal regulations. 18 The bill transfers all unencumbered and unobligated moneys 19 in the Iowa comprehensive petroleum underground storage tank 20 fund on the effective date of the bill to the storage tank 21 management account. The bill provides that moneys transferred 22 to the storage tank management account pursuant to the bill 23 shall be used to reimburse tank owners for the costs associated 24 with a corrective action for a petroleum release and that 25 at least $3 million of the moneys transferred from the Iowa 26 comprehensive petroleum underground storage tank fund to the 27 storage tank management account shall be used for the permanent 28 closure of underground storage tank systems, actions arising 29 from sites where certificates of no further action have been 30 issued, and tank operator training. 31 -2- LSB 6274XC (5) 90 lh/js 2/ 2
