S.F. _____ Section 1. Section 26.16, Code 2024, is amended to read as 1 follows: 2 26.16 Prequalification requirements prohibited. 3 1. A Except to the extent provided in subsection 2, a 4 governmental entity shall not by ordinance, rule, or any 5 other action relating to contracts for public improvements 6 for which competitive bids are required by this chapter 7 impose any requirement that directly or indirectly restricts 8 potential bidders to any predetermined class of bidders defined 9 by experience on similar projects, size of company, union 10 membership, or any other criteria. However, a governmental 11 entity shall require nonresident bidders to comply with section 12 8A.311B, subsection 4 . 13 2. A governmental entity may require bidders to meet 14 prequalification requirements related to production and 15 manufacturing for public safety infrastructure to be 16 constructed for or public safety technology to be purchased by 17 the governmental entity, including for traffic control devices, 18 cameras, computers, software, unmanned aerial vehicles, and 19 solar, wind, or other energy infrastructure or technology. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill relates to prequalification requirements for the 24 construction of public safety infrastructure for and purchase 25 of public safety technology by a governmental entity. Under 26 current law, a governmental entity shall not impose any 27 requirement that directly or indirectly restricts potential 28 bidders to a predetermined class of bidders defined by certain 29 criteria.
