subsection
2,
Code
2024,
is

amended
to
read
as
follows:

2.
A
person
operating
an
all-terrain
vehicle
on
a
highway
3
shall
have
a
valid
driver’s
license
and
operate
the
vehicle
at
4
speeds
of
thirty-five
miles
per
hour
or
less
.
In
addition,
a
5
person
operating
an
all-terrain
vehicle
on
a
highway
pursuant
6
to
subsection
1
,
paragraphs
“b”
through
“g”
,
shall
be
at
least
7
eighteen
years
of
age
and
have
financial
liability
coverage
8
in
effect
for
the
vehicle
and
carry
proof
of
such
financial
9
liability
coverage
in
accordance
with
section
321.20B
.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
12
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
strikes
the
35-mile-per-hour
(MPH)
speed
limit
14
for
a
person
operating
an
all-terrain
vehicle
(ATV)
on
a
15
highway.
However,
if
an
ATV
is
operated
at
speeds
of
35
16
MPH
or
less
between
sunrise
and
sunset,
and
the
operation
is
17
incidental
to
the
vehicle’s
use
for
agricultural
purposes,
18
the
ATV
is
still
considered
an
implement
of
husbandry
and
19
exempt
from
registration,
licensing,
and
certain
vehicle
20
equipment
requirements.
Under
Code
chapter
321,
an
ATV
is
a
21
motor
vehicle
and
subject
to
the
applicable
speed
limit
on
the
22
highway.
