S.F. _____ Section 1. Section 614.1, Code 2023, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 11A. Sexual offenses —— minors. An action 3 for damages for injury suffered as a result of sexual abuse in 4 the first degree as described in section 709.2, sexual abuse in 5 the second degree as described in section 709.3, sexual abuse 6 in the third degree as described in section 709.4, lascivious 7 acts with a child as described in section 709.8, or assault 8 with intent to commit sexual abuse as described in section 9 709.11, committed on or with a person who was under the age of 10 eighteen years at the time of the offense may be commenced at 11 any time after the conviction for the offense. 12 Sec. 2. Section 614.8, subsection 2, Code 2023, is amended 13 to read as follows: 14 2. Except as provided in section 614.1, subsection 15 subsections 9 and 11A , the times limited for actions in this 16 chapter , or chapter 216 , 659A , 669 , or 670 , except those 17 brought for penalties and forfeitures, are extended in favor 18 of minors, so that they shall have one year from and after 19 attainment of majority within which to file a complaint 20 pursuant to chapter 216 , to make a claim pursuant to chapter 21 659A, 669 , or 670, or to otherwise commence an action. 22 Sec. 3. Section 614.8A, Code 2023, is amended to read as 23 follows: 24 614.8A Damages for child sexual abuse —— time limitation. 25 An Except as provided in section 614.1, subsection 11A, an 26 action for damages for injury suffered as a result of sexual 27 abuse which occurred when the injured person was a child, but 28 not discovered until after the injured person is of the age 29 of majority, shall be brought within four years from the time 30 of discovery by the injured party of both the injury and the 31 causal relationship between the injury and the sexual abuse. 32 EXPLANATION 33 The inclusion of this explanation does not constitute agreement with 34 the explanation’s substance by the members of the general assembly. 35 -1- LSB 2514XC (5) 90 cm/ns 1/ 2
