A person who commits an assault, as defined in section 3 708.1 , against a peace officer, jailer, correctional staff, 4 member or employee of the board of parole, health care 5 provider, employee of the department of human services, 6 employee of the department of revenue, national guard member 7 engaged in national guard duty or state active duty, civilian 8 employee of a law enforcement agency, civilian employee of a 9 fire department, or fire fighter, whether paid or volunteer, 10 or sports official, with the knowledge that the person against 11 whom the assault is committed is a peace officer, jailer, 12 correctional staff, member or employee of the board of parole, 13 health care provider, employee of the department of human 14 services, employee of the department of revenue, national 15 guard member engaged in national guard duty or state active 16 duty, civilian employee of a law enforcement agency, civilian 17 employee of a fire department, or fire fighter , or sports 18 official, and with the intent to inflict a serious injury 19 upon the peace officer, jailer, correctional staff, member 20 or employee of the board of parole, health care provider, 21 employee of the department of human services, employee of 22 the department of revenue, national guard member engaged in 23 national guard duty or state active duty, civilian employee 24 of a law enforcement agency, civilian employee of a fire 25 department, or fire fighter, or sports official, is guilty of a 26 class “D” felony. 27 2. S.F. _____ or sports official, who knows that the person against whom the 1 assault is committed is a peace officer, jailer, correctional 2 staff, member or employee of the board of parole, health 3 care provider, employee of the department of human services, 4 employee of the department of revenue, national guard member 5 engaged in national guard duty or state active duty, civilian 6 employee of a law enforcement agency, civilian employee of a 7 fire department, or fire fighter , or sports official, and who 8 uses or displays a dangerous weapon in connection with the 9 assault, is guilty of a class “D” felony. 10 3. A person who commits an assault, as defined in section 11 708.1 , against a peace officer, jailer, correctional staff, 12 member or employee of the board of parole, health care 13 provider, employee of the department of human services, 14 employee of the department of revenue, national guard member 15 engaged in national guard duty or state active duty, civilian 16 employee of a law enforcement agency, civilian employee of a 17 fire department, or fire fighter, whether paid or volunteer, 18 or sports official, who knows that the person against whom the 19 assault is committed is a peace officer, jailer, correctional 20 staff, member or employee of the board of parole, health 21 care provider, employee of the department of human services, 22 employee of the department of revenue, national guard member 23 engaged in national guard duty or state active duty, civilian 24 employee of a law enforcement agency, civilian employee of 25 a fire department, or fire fighter, or sports official, and 26 who causes bodily injury or mental illness, is guilty of an 27 aggravated misdemeanor. 28 4. Any other assault, as defined in section 708.1 , committed 29 against a peace officer, jailer, correctional staff, member 30 or employee of the board of parole, health care provider, 31 employee of the department of human services, employee of 32 the department of revenue, national guard member engaged in 33 national guard duty or state active duty, civilian employee 34 of a law enforcement agency, civilian employee of a fire 35 -2- LSB 2322XC (3) 90 as/rh 2/ 4
S.F. _____ department, or fire fighter, whether paid or volunteer, or 1 sports official, by a person who knows that the person against 2 whom the assault is committed is a peace officer, jailer, 3 correctional staff, member or employee of the board of parole, 4 health care provider, employee of the department of human 5 services, employee of the department of revenue, national 6 guard member engaged in national guard duty or state active 7 duty, civilian employee of a law enforcement agency, civilian 8 employee of a fire department, or fire fighter, or sports 9 official, is a serious misdemeanor. 10 Sec. 2. Section 708.3A, subsection 5, Code 2023, is amended 11 by adding the following new paragraph: 12 NEW PARAGRAPH . 0h. “Sports official” means an individual 13 who serves as a referee, umpire, or linesman, or in a similar 14 capacity, at any athletic contest, and who is a member of 15 or registered with a local, state, regional, or national 16 organization that is engaged, in part, in providing education 17 and training to referees, umpires, linesmen, or persons in 18 similar capacities. 19 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 20 importance, takes effect upon enactment. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill relates to assaults on sports officials. 25 Current law provides that a person who commits an assault, 26 as defined in Code section 708.1, with the knowledge that 27 the other person is a peace officer, jailer, correctional 28 staff, member or employee of the board of parole, health 29 care provider, employee of the department of human services, 30 employee of the department of revenue, national guard member 31 engaged in national guard duty or state active duty, civilian 32 employee of a law enforcement agency, civilian employee of a 33 fire department, or fire fighter, whether paid or volunteer, is 34 guilty of an offense with penalties ranging from an aggravated 35 -3- LSB 2322XC (3) 90 as/rh 3/ 4
S.F. _____ misdemeanor up to a class “D” felony. The bill adds “sports 1 officials” to the list of protected occupations. 2 The bill provides that a person who commits an assault 3 against a sports official, with the knowledge that the person 4 against whom the assault is committed is a sports official, 5 and with the intent to commit a serious injury, is guilty of a 6 class “D” felony. The bill provides that a person who commits 7 an assault against a sports official, who knows that the person 8 against whom the assault is committed is a sports official, and 9 who uses or displays a dangerous weapon in connection with the 10 assault, is guilty of a class “D” felony. The bill provides 11 that a person who commits an assault against a sports official, 12 who knows that the person against whom the assault is committed 13 is a sports official, and who causes bodily injury or mental 14 illness, is guilty of an aggravated misdemeanor. The bill 15 provides that any other assault committed against a sports 16 official by a person who knows that the person against whom 17 the assault is committed is a sports official is a serious 18 misdemeanor. 19 A class “D” felony is punishable by confinement for no 20 more than five years and a fine of at least $1,025 but not 21 more than $10,245. An aggravated misdemeanor is punishable 22 by confinement for no more than two years and a fine of at 23 least $855 but not more than $8,540. A serious misdemeanor is 24 punishable by confinement for no more than one year and a fine 25 of at least $430 but not more than $2,560. 26 The bill defines “sports official” as an individual who 27 serves as a referee, umpire, or linesman, or in a similar 28 capacity, at any athletic contest, and who is a member of 29 or registered with a local, state, regional, or national 30 organization that is engaged, in part, in providing education 31 and training to sports officials. 32 The bill takes effect upon enactment. 33 -4- LSB 2322XC (3) 90 as/rh 4/ 4
