Notwithstanding section 8.33 , moneys appropriated in 5 this subsection that remain unencumbered or unobligated at the 6 close of the fiscal year shall not revert but shall remain 7 available for expenditure for the purposes designated until the 8 close of the succeeding fiscal year. 9 3. AGRICULTURAL EDUCATION 10 a. For purposes of allocating moneys to an Iowa association 11 affiliated with a national organization that promotes 12 agricultural education providing for future farmers: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 14 b. FARMERS WITH DISABILITIES PROGRAM 24 a. The moneys appropriated in this subsection shall be 28 used for the public purpose of providing a grant to a national 29 nonprofit organization with over 80 years of experience in 30 assisting children and adults with disabilities and special 31 needs. The moneys shall be used to support a nationally 32 recognized program that began in 1986 and has been replicated 33 in at least 30 other states, but is not available through 34 any other entity in this state, and that provides assistance 35 -3- LSB 1001SV (1) 90 js/ns 3/ 22
S.F. 558 to farmers with disabilities in all 99 counties to allow the 1 farmers to remain in their own homes and be gainfully engaged 2 in farming through provision of agricultural worksite and home 3 modification consultations, peer support services, services 4 to families, information and referral, and equipment loan 5 services. 6 c. Notwithstanding section 8.33 , moneys appropriated in 7 this subsection that remain unencumbered or unobligated at the 8 close of the fiscal year shall not revert but shall remain 9 available for expenditure for the purposes designated until the 10 close of the succeeding fiscal year. 11 6. LOESS HILLS DEVELOPMENT AND CONSERVATION FUND 12 a. For deposit in the loess hills development and 13 conservation fund created pursuant to section 161D.2 : 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 15 b. Of the number of full-time equivalent positions 1 authorized to the department pursuant to subsection 1, _____ 2 full-time equivalent positions shall be allocated by the 3 department for seasonal employees for purposes of providing 4 maintenance, upkeep, and sanitary services at state parks. 5 This subsection shall not impact conservation officer, park 6 ranger, or park manager positions within the department. 7 3. The department shall submit a report each quarter of 8 the fiscal year to the general assembly and the department 9 of management. The report shall describe in detail the 10 expenditure of moneys appropriated under this section to 11 support the department’s administration, regulation, and 12 programs. 13 Sec. 6. STATE FISH AND GAME PROTECTION FUND —— REGULATION 14 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 15 1. There is appropriated from the state fish and game 16 protection fund created pursuant to section 456A.17 to the 17 department of natural resources for the fiscal year beginning 18 July 1, 2023, and ending June 30, 2024, the following amount, 19 or so much thereof as is necessary, to be used for the purposes 20 designated: 21 For purposes of supporting the regulation or advancement of 22 hunting, fishing, or trapping, or the protection, propagation, 23 restoration, management, or harvest of fish or wildlife, 24 including for administration, regulation, law enforcement, and 25 programs; and for salaries, support, maintenance, equipment, 26 and miscellaneous purposes: 27 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 28 2. Notwithstanding section 455A.10 , the department may use 29 the unappropriated balance remaining in the state fish and game 30 protection fund to provide for the funding of health and life 31 insurance premium payments from unused sick leave balances of 32 conservation peace officers employed in a protection occupation 33 who retire, pursuant to section 97B.49B . 34 3. Notwithstanding section 455A.10 , the department may 35 -6- LSB 1001SV (1) 90 js/ns 6/ 22
S.F. 558 use the unappropriated balance remaining in the state fish 1 and game protection fund for the fiscal year beginning July 2 1, 2023, and ending June 30, 2024, as is necessary to fund 3 salary adjustments for departmental employees for which the 4 general assembly has made an operating budget appropriation in 5 subsection 1. 6 Sec. 7. GROUNDWATER PROTECTION FUND —— WATER QUALITY. There 7 is appropriated from the groundwater protection fund created 8 in section 455E.11 to the department of natural resources for 9 the fiscal year beginning July 1, 2023, and ending June 30, 10 2024, from those moneys that are not allocated pursuant to 11 that section, the following amount, or so much thereof as is 12 necessary, to be used for the purposes designated: 13 For purposes of supporting the department’s protection 14 of the state’s groundwater, including for administration, 15 regulation, and programs, and for salaries, support, 16 maintenance, equipment, and miscellaneous purposes: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 18 DESIGNATED APPROPRIATIONS FROM MISCELLANEOUS FUNDS 19 Sec. 8. VETERINARY DIAGNOSTIC LABORATORY. 7 1. There is appropriated from the general fund of the state 8 to Iowa state university of science and technology for the 9 fiscal year beginning July 1, 2023, and ending June 30, 2024, 10 the following amount, or so much thereof as is necessary, to be 11 used for the purposes designated: 12 For purposes of supporting the college of veterinary 13 medicine for the operation of the veterinary diagnostic 14 laboratory and for not more than the following full-time 15 equivalent positions: 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Iowa state university of science and technology 19 shall not reduce the amount that it allocates to support the 20 college of veterinary medicine from any other source due to the 21 appropriation made in this section. 22 b. Paragraph “a” does not apply to a reduction made to 23 support the college of veterinary medicine, if the same 24 percentage of reduction imposed on the college of veterinary 25 medicine is also imposed on all of Iowa state university of 26 science and technology’s budget units. 27 3. If by June 30, 2024, Iowa state university of science and 28 technology fails to allocate the moneys appropriated in this 29 section to the college of veterinary medicine in accordance 30 with this section, the moneys appropriated in this section for 31 that fiscal year shall revert to the general fund of the state. 32 Sec. 12. LIVESTOCK DISEASE RESEARCH. 33 1. There is appropriated from the general fund of the state 34 to Iowa state university of science and technology for the 35 -9- LSB 1001SV (1) 90 js/ns 9/ 22
S.F. 558 fiscal year beginning July 1, 2023, and ending June 30, 2024, 1 the following amount, or so much thereof as is necessary, to be 2 used for the purposes designated: 3 For deposit in the livestock disease research fund created 4 in section 267.8 : 5 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 6 2. Moneys appropriated under subsection 1 shall be used 7 by Iowa state university of science and technology to support 8 animal disease research in areas of importance to livestock 9 producers. 10 DIVISION IV 11 STATE UNIVERSITY OF IOWA 12 SPECIAL GENERAL FUND APPROPRIATIONS 13 Sec. 13. IOWA’S CENTER FOR AGRICULTURAL SAFETY AND HEALTH 14 (I-CASH). 15 1. There is appropriated from the general fund of the state 16 to the state university of Iowa for the fiscal year beginning 17 July 1, 2023, and ending June 30, 2024, the following amount, 18 or so much thereof as is necessary, to be used for the purposes 19 designated: 20 For supporting the operations of Iowa’s center for 21 agricultural safety and health, as part of the university’s 22 college of public health, and in cooperation with the 23 department of agriculture and land stewardship, to anticipate, 24 recognize, and prevent occupational illness and injury among 25 members of the agricultural community: 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 27 2. a. As a condition of the appropriation made in 28 subsection 1, the state university of Iowa shall retain the 29 director of Iowa’s center for agricultural safety and health 30 employed on the effective date of this division of this Act for 31 at least the same number of hours for the fiscal year beginning 32 July 1, 2023, as worked by the director during the fiscal year 33 beginning July 1, 2022. 34 b. As a condition of the appropriation made in subsection 35 -10- LSB 1001SV (1) 90 js/ns 10/ 22
S.F. 558 1, the state university of Iowa shall not reduce the amount 1 allocated to support Iowa’s center for agricultural safety and 2 health from any other source due to the appropriation made in 3 subsection 1. 4 3. If by June 30, 2024, the state university of Iowa fails 5 to use the moneys appropriated in subsection 1 in accordance 6 with the purposes and conditions of subsections 1 and 2, any 7 unencumbered or unobligated moneys appropriated in subsection 8 1 for the fiscal year beginning July 1, 2023, and ending June 9 30, 2024, shall revert to the general fund of the state. In 10 addition, if moneys revert as required pursuant to section 11 8.33 , the state university of Iowa shall transfer to the 12 general fund of the state from any otherwise unencumbered or 13 unobligated moneys from any other general fund appropriation or 14 from any moneys available from other funding sources an amount 15 equal to the amount appropriated in subsection 1 less any 16 amount that reverted to the general fund of the state pursuant 17 to section 8.33 . 18 DIVISION V 19 ENVIRONMENT FIRST FUND 20 GENERAL APPROPRIATIONS 21 Sec. 14. DEPARTMENT OF AGRICULTURE AND LAND 22 STEWARDSHIP. There is appropriated from the environment first 23 fund created in section 8.57A to the department of agriculture 24 and land stewardship for the fiscal year beginning July 1, 25 2023, and ending June 30, 2024, the following amounts, or so 26 much thereof as is necessary, to be used for the purposes 27 designated: 28 1. CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP) 29 a. For the conservation reserve enhancement program to 30 restore and construct wetlands for the purposes of intercepting 31 tile line runoff, reducing nutrient loss, improving water 32 quality, and enhancing agricultural production practices: 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 34 b. Notwithstanding any other provision of law, the 3 department may use moneys appropriated in this subsection, 4 in combination with other appropriate environment first 5 fund appropriations, for cost sharing to match United States 6 department of agriculture, natural resources conservation 7 service, wetlands reserve enhancement program (WREP) funding 8 available to Iowa. 9 2. WATERSHED PROTECTION 10 a. For continuation of a program that provides 11 multiobjective resource protections for flood control, water 12 quality, erosion control, and natural resource conservation: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 14 b. Not more than 10 percent of the moneys appropriated 15 in paragraph “a” may be used for costs of administration and 16 implementation of soil and water conservation practices. 17 3. To encourage and assist farmers in enrolling in and the 19 implementation of the federal conservation reserve program and 20 to work with them to enhance their revegetation efforts to 21 improve water quality and habitat: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ ___ 23 b. Not more than 10 percent of the moneys appropriated 24 in paragraph “a” may be used for costs of administration and 25 implementation of soil and water conservation practices. 26 4. SOIL AND WATER CONSERVATION 27 a. Notwithstanding section 8.33 , moneys appropriated for 7 the fiscal year beginning July 1, 2023, in this division of 8 this Act to the department of agriculture and land stewardship 9 to provide financial assistance for the establishment of 10 permanent soil and water conservation practices that remain 11 unencumbered or unobligated at the close of the fiscal year 12 shall not revert but shall remain available for expenditure 13 for the purposes designated until the close of the fiscal year 14 beginning July 1, 2026. 15 2. Subsection 1 does not apply to moneys transferred 16 pursuant to this division of this Act to the loess hills 17 development and conservation fund created in section 161D.2 , 18 which shall not revert as provided in that section. 19 DIVISION VI 20 ENVIRONMENT FIRST FUND 21 SPECIAL APPROPRIATIONS 22 Sec. 18. WATER QUALITY INITIATIVE —— DEPARTMENT OF 23 AGRICULTURE AND LAND STEWARDSHIP. 24 1. There is appropriated from the environment first fund 25 created in section 8.57A to the department of agriculture 26 and land stewardship for the fiscal year beginning July 1, 27 2023, and ending June 30, 2024, the following amount, or so 28 much thereof as is necessary, to be used for the purposes 29 designated: 30 For deposit in the water quality initiative fund created in 31 section 466B.45 , for purposes of supporting the water quality 32 initiative administered by the division of soil conservation 33 and water quality as provided in section 466B.42 , including 34 salaries, support, maintenance, and miscellaneous purposes: 35 -16- LSB 1001SV (1) 90 js/ns 16/ 22

The moneys appropriated in subsection 1 shall be 2 used to support projects in subwatersheds as designated by the 3 division that are part of high-priority watersheds identified 4 by the water resources coordinating council established 5 pursuant to section 466B.3 . 6 b. The moneys appropriated in subsection 1 shall be used to 7 support projects in watersheds generally, including regional 8 watersheds, as designated by the division and high-priority 9 watersheds identified by the water resources coordinating 10 council established pursuant to section 466B.3 . 11 3. In supporting projects in subwatersheds and watersheds 12 as provided in subsection 2, all of the following apply: 13 a. The demonstration projects shall utilize water quality 14 practices as described in the Iowa nutrient reduction strategy 15 as defined in section 455B.171 . 16 b. The division shall implement demonstration projects as 17 provided in paragraph “a” by providing for participation by 18 persons who hold a legal interest in agricultural land used in 19 farming. To every extent practical, the division shall provide 20 for collaborative participation by such persons who hold a 21 legal interest in agricultural land located within the same 22 subwatershed. 23 c. The division shall implement a demonstration project on 24 a cost-share basis as determined by the division. However, 25 except for edge-of-field practices, the state’s share of the 26 amount shall not exceed 50 percent of the estimated cost of 27 establishing the practice as determined by the division or 28 50 percent of the actual cost of establishing the practice, 29 whichever is less. 30 d. The demonstration projects shall be used to educate other 31 persons about the feasibility and value of establishing similar 32 water quality practices. The division shall promote field day 33 events for purposes of allowing interested persons to establish 34 water quality practices on their agricultural land. 35 -17- LSB 1001SV (1) 90 js/ns 17/ 22
S.F. 558 e. The division shall conduct water quality evaluations 1 within supported subwatersheds. Within a reasonable period 2 after accumulating information from such evaluations, the 3 division shall create an aggregated database of water quality 4 practices. Any information identifying a person holding a 5 legal interest in agricultural land or specific agricultural 6 land shall be a confidential record under section 22.7 . 7 4. The moneys appropriated in subsection 1 shall be used 8 to support education and outreach in a manner that encourages 9 persons who hold a legal interest in agricultural land used for 10 farming to implement water quality practices, including the 11 establishment of such practices in watersheds generally, and 12 not limited to subwatersheds or high-priority watersheds. 13 5. The moneys appropriated in subsection 1 may be used 14 to contract with persons to coordinate the implementation of 15 efforts provided in this section. 16 6. The moneys appropriated in subsection 1 may be used by 17 the department to support urban soil and water conservation 18 efforts, which may include but are not limited to management 19 practices related to bioretention, landscaping, the use of 20 permeable or pervious pavement, and soil quality restoration. 21 The moneys shall be allocated on a cost-share basis as provided 22 in chapter 161A . 23 7. Notwithstanding any other provision of law to the 24 contrary, the department may use moneys appropriated in 25 subsection 1 to carry out the provisions of this section on a 26 cost-share basis in combination with other moneys available to 27 the department from a state or federal source. 28 8. Not more than 10 percent of the moneys appropriated in 29 this section may be used to pay for the costs of administering 30 and implementing the water quality initiative by the 31 department’s division of soil conservation and water quality as 32 provided in section 466B.42 and this section. 33 DIVISION VII 34 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND 35 -18- LSB 1001SV (1) 90 js/ns 18/ 22

Notwithstanding section 455A.19, 10 subsection 1 , paragraph “a”, subparagraph (1), of the moneys 11 allocated to the open spaces account of the Iowa resources 12 enhancement and protection fund, up to $_________ may be 13 used by the department of natural resources for state park 14 maintenance and repair for the fiscal year beginning July 1, 15 2023, and ending on June 30, 2024. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 GENERAL. This bill relates to agriculture and natural 20 resources by making appropriations for FY 2023-2024 to support 21 related entities, including the department of agriculture and 22 land stewardship (DALS), the department of natural resources 23 (DNR), Iowa state university (ISU), and the university of Iowa 24 (UI). 25 The bill primarily appropriates moneys to DALS and DNR. 26 The appropriations are made to support those departments for 27 administration, regulation, and support of programs. The bill 28 requires the departments to submit quarterly reports to the 29 general assembly and department of management regarding the 30 expenditure of appropriated moneys. The bill also provides 31 moneys to support specific programs or projects administered by 32 those departments. 33 The bill primarily appropriates moneys from the state 34 general fund (GF) and the environment first fund (EFF) to 35 -19- LSB 1001SV (1) 90 js/ns 19/ 22
S.F. 558 support DALS and DNR, but also UI and ISU, and to support 1 a number of designated activities, projects, and programs 2 administered by those agencies. General appropriations are 3 made from other major sources, including the state fish and 4 game protection fund (SFGPF) and the groundwater protection 5 fund (GPF), both administered by DNR. Finally, appropriations 6 are made from and to a number of dedicated sources, including 7 the resources enhancement and protection (REAP) fund 8 administered by DNR, and the renewable fuel infrastructure 9 fund (RFIF) and the water quality initiative fund (WQIF) 10 administered by DALS. 11 DALS —— GF APPROPRIATIONS. The bill appropriates moneys 12 to DALS from the GF in order to support its administrative 13 divisions, including consumer protection and industry services, 14 soil conservation, and food safety and animal health. Moneys 15 are transferred to ISU to support its midwest grape and wine 16 industry institute. 17 DALS —— DESIGNATED APPROPRIATIONS FROM MISCELLANEOUS FUNDS. 18 The bill appropriates moneys from several sources to support a 19 number of designated purposes, including moneys derived from 20 unclaimed winnings from horse and dog races, for administration 21 and enforcement of racing regulations; and moneys credited to 22 the RFIF, for purposes of regulating motor fuel. 23 DALS —— SPECIAL GF APPROPRIATIONS. The bill makes special 24 appropriations from the GF to DALS in order to support specific 25 purposes including milk inspection, the local food and farm 26 program, an agricultural education organization, foreign animal 27 disease preparedness, assistance to farmers with disabilities, 28 loess hills protections, southern Iowa development and 29 conservation, grain regulation, a value added agriculture grant 30 program, and the choose Iowa promotional program. 31 DNR —— GF AND OTHER MAJOR FUNDS APPROPRIATIONS. The bill 32 makes appropriations from a number of funds to DNR in order 33 to support its administrative divisions involving natural 34 resources and environmental protection from the GF, the SFGPF, 35 -20- LSB 1001SV (1) 90 js/ns 20/ 22
S.F. 558 and the GPF. 1 DNR —— DESIGNATED APPROPRIATIONS FROM MISCELLANEOUS FUNDS. 2 The bill appropriates moneys to DNR from a number of sources 3 to support designated purposes, including moneys deposited in 4 the special snowmobile fund to provide for administering and 5 enforcing the state snowmobile programs; and moneys deposited 6 in the unassigned revenue fund for purposes of paying for 7 administration of DNR’s underground storage tanks section. 8 DNR —— SPECIAL GF APPROPRIATIONS. The bill makes special 9 appropriations from the GF to DNR in order to support specific 10 purposes including floodplain management, dam safety and 11 forestry health management programs, and state parks. 12 ISU —— SPECIAL GF APPROPRIATIONS. The bill appropriates 13 moneys from the GF to ISU to support the operation of its 14 veterinary diagnostic laboratory and livestock disease 15 research. 16 UI —— SPECIAL GF APPROPRIATIONS. The bill appropriates 17 moneys from the GF to UI to support the operations of Iowa’s 18 center for agricultural safety and health, which is part of 19 UI’s college of public health. 20 DALS, DNR, AND UI —— EFF —— GENERAL APPROPRIATIONS. The 21 bill appropriates moneys from the EFF to support a number of 22 programs administered by DALS, DNR, and UI. For DALS, the 23 moneys are appropriated to support programs involving soil 24 conservation, watershed protection and nutrient management, 25 and the loess hills development and conservation fund. For 26 DNR, moneys are appropriated to support programs involving 27 state parks, geographic information systems, water quality 28 monitoring, public water supplies, regulation of animal feeding 29 operations, air quality, and floodplain management and dam 30 safety. For UI, moneys are appropriated to support the Iowa 31 geological survey. The bill includes provisions that delay the 32 reversion of these moneys. 33 EFF —— SPECIAL APPROPRIATIONS FOR WQIF. The bill 34 appropriates moneys from the EFF to the WQIF subject to certain 35 -21- LSB 1001SV (1) 90 js/ns 21/ 22
S.F. 558 conditions. 1 REAP FUND —— EFF APPROPRIATION IN LIEU OF GF APPROPRIATION. 2 The bill appropriates moneys from the EFF to the REAP 3 fund instead of the $20 million otherwise required to be 4 appropriated to the REAP fund from the GF.
