S.F. 511 Section 1. Section 692.1, subsection 7, Code 2023, is 1 amended to read as follows: 2 7. “Criminal or juvenile justice agency” means an either of 3 the following: 4 a. An agency or department of any level of government 5 or an entity wholly owned, financed, or controlled by one 6 or more such agencies or departments which performs as its 7 principal function the apprehension, prosecution, adjudication, 8 incarceration, or rehabilitation of criminal or juvenile 9 offenders. 10 b. The department of health and human services and agents 11 and employees of the department of health and human services, 12 including county attorneys and assistant county attorneys, 13 who have been appointed by a juvenile court to represent 14 the department of health and human services in a proceeding 15 alleging that a child is a child in need of assistance as 16 defined in section 232.2. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to access to criminal history and 21 intelligence data in child in need of assistance proceedings. 22 The bill adds to the definition of “criminal or juvenile 23 justice agency” (relating to the provision of criminal history 24 and intelligence data under Code chapter 692) the department of 25 health and human services (HHS) and HHS agents and employees, 26 including county attorneys and assistant county attorneys, 27 who have been appointed by a juvenile court to represent HHS 28 in a proceeding alleging that a child is a child in need of 29 assistance. 30 For the purposes of Code chapter 692, “criminal history 31 data” means any or all of the following information maintained 32 by the department of public safety or the division of criminal 33 investigation of the department of public safety in a manual or 34 automated data storage system that is individually identified: 35 -1- LSB 1396SV (3) 90 dg/rh 1/ 2
S.F. 511 arrest data, conviction data, disposition data, correctional 1 data, adjudication data, and custody data; and “intelligence 2 data” means information on identifiable individuals compiled in 3 an effort to anticipate, prevent, or monitor possible criminal 4 activity. 5 -2- LSB 1396SV (3) 90 dg/rh 2/ 2
