S.F. 405 Section 1. Section 614.1, unnumbered paragraph 1, Code 1 2023, is amended to read as follows: 2 Actions may be brought within the times limited as follows, 3 respectively, after their causes accrue, and not afterwards, 4 except as provided in section 614.1A or when otherwise 5 specially declared: 6 Sec. 2. NEW SECTION . 614.1A Toll —— COVID-19. 7 Any statute of limitations, statute of repose, or similar 8 deadline for commencing an action in district court that would 9 have otherwise expired between March 17, 2020, and December 31, 10 2020, is tolled by seventy-six days. 11 Sec. 3. REPEAL. This Act is repealed July 1, 2032. 12 Sec. 4. RETROACTIVE APPLICABILITY. This Act applies 13 retroactively to March 17, 2020. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to statutes of limitations tolled by the 18 Iowa supreme court. The bill codifies Iowa supreme court 19 emergency orders which tolled the statute of limitations for 20 commencing civil and criminal actions in the district court. 21 The limitation periods are extended by 76 days for actions 22 that would have otherwise expired between March 17, 2020, and 23 December 31, 2020. 24 The bill is repealed July 1, 2032, and applies retroactively 25 to March 17, 2020. 26 -1- LSB 1488XS (2) 90 cm/ns 1/ 1
