S.F. 404 Section 1. Section 267.1, Code 2023, is amended by striking 1 the section and inserting in lieu thereof the following: 2 267.1 Definitions. 3 As used in this chapter, unless the context otherwise 4 requires: 5 1. “College of veterinary medicine” means the Iowa state 6 university of science and technology college of veterinary 7 medicine. 8 2. “Council” means the livestock health advisory council 9 created pursuant to section 267.2. 10 3. “Fund” means the livestock disease research fund created 11 in section 267.8. 12 4. “Livestock” means the same as defined in section 717.1. 13 5. “Member organization” means an organization appointing 14 one or more members to the council pursuant to sections 267.2 15 and 267.3. 16 6. “Producer” means a person engaged in the business of 17 producing livestock for profit. 18 Sec. 2. Section 267.2, Code 2023, is amended to read as 19 follows: 20 267.2 Livestock health advisory council creation and 21 membership . 22 1. There is a A livestock health advisory council , referred 23 to in this chapter as the council is created to support 24 research of livestock diseases conducted by the college of 25 veterinary medicine . 26 2. The council shall consist of all of the following : 27 1. a. Three cattle producers appointed by the Iowa 28 cattlemen’s association, one of whom shall serve an initial 29 term of one year, and one of whom shall serve an initial term 30 of two years. 31 2. b. Three swine producers appointed by the Iowa pork 32 producers association, one of whom shall serve an initial term 33 of one year. 34 3. c. S.F. 404 producers association who shall serve an initial term of one 1 year. 2 4. d. One poultry producer appointed by the Iowa north 3 central poultry association who shall serve an initial term of 4 two years. 5 e. One turkey producer appointed by the Iowa turkey 6 federation who shall serve an initial term of three years. 7 5. f. One milk producer appointed by the Iowa state dairy 8 association who shall serve an initial term of two years ; and . 9 6. g. One practicing veterinarian appointed by the Iowa 10 veterinary medical association. 11 Sec. 3. Section 267.3, Code 2023, is amended to read as 12 follows: 13 267.3 Terms and vacancies —— expenses and compensation 14 prohibited . 15 1. Except as provided in section 267.2 , each member of 16 the council shall be appointed by a member organization for a 17 three-year term beginning on July 1 of the year of appointment. 18 No A member shall not serve more than two terms, including any 19 portion of a term served pursuant to the filling of a vacancy. 20 Vacancies A vacancy shall be filled by the appropriate member 21 organization in the same manner as appointing a full-term 22 members member . 23 2. A member of the council is not entitled to receive 24 expenses incurred in the discharge of the member’s duties 25 on the council. A member is also not entitled to receive 26 compensation as otherwise provided in section 7E.6. 27 Sec. 4. Section 267.5, Code 2023, is amended to read as 28 follows: 29 267.5 Duties and objectives of council. 30 The livestock health advisory council shall do all of the 31 following : 32 1. Elect a chairperson and such other officers as it deems 33 advisable. Officers of the council shall serve for terms of 34 one year. S.F. 404 more than two terms. 1 2. Hold a meeting twice each year at Iowa state university 2 of science and technology. The council shall meet with the 3 Iowa state university faculty of the college of veterinary 4 medicine. Hold The council may hold other such meetings as 5 the council may determine necessary, or as required by section 6 267.6 . No An action taken by the council shall not be valid 7 unless agreed to by a majority of the council members. 8 3. a. Make By the beginning of each fiscal year, make 9 recommendations to the Iowa state university college of 10 veterinary medicine concerning the application expenditure of 11 funds appropriated to the college of veterinary medicine moneys 12 in the fund . 13 b. The Iowa state university college of veterinary medicine 14 shall not expend any of the funds appropriated by this chapter 15 until the recommendation of the council concerning that 16 appropriation is adopted or sixty days following the effective 17 date of the appropriation, whichever is earlier The college of 18 veterinary medicine shall not obligate moneys in the fund for 19 a fiscal year until the council makes timely recommendations 20 for the expenditure of those moneys for that fiscal year as 21 required in paragraph “a” . 22 4. File an annual report with the secretary of agriculture. 23 Sec. 5. Section 267.7, Code 2023, is amended to read as 24 follows: 25 267.7 Other funds moneys . 26 In addition to the funds appropriated to it by this chapter 27 moneys in the fund , the Iowa state university college of 28 veterinary medicine may accept grants, gifts, matching funds 29 moneys , or any other funds moneys for research into the 30 diseases of affecting livestock . The moneys may be from any 31 source, public or private. 32 Sec. 6. Section 267.8, Code 2023, is amended to read as 33 follows: 34 267.8 Livestock disease research fund. 35 -3- LSB 2274XS (3) 90 da/ns 3/ 4
S.F. 404 There is created in the office of the treasurer of state 1 a fund to be known as the livestock disease research fund. 2 Moneys in the fund are appropriated for use by the college of 3 veterinary medicine to conduct research of diseases affecting 4 livestock. Any balance in said fund on June 30 of each fiscal 5 year shall revert to the general fund. 6 Sec. 7. REPEAL. Section 267.4, Code 2023, is repealed. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 BACKGROUND. This bill amends provisions in Code chapter 11 267 which establishes and provides for the administration of 12 the livestock health advisory council (council) which meets 13 twice each year and provides recommendations to the Iowa state 14 university of science and technology’s college of veterinary 15 medicine (college). The board includes members appointed by 16 organizations of livestock producers (member organizations), 17 including cattle, swine, sheep, poultry, and milk. One 18 member is a practicing member of the Iowa veterinary medical 19 association. The college’s research into diseases affecting 20 livestock is supported by the livestock disease research fund 21 (fund) which may be appropriated moneys by the general assembly 22 (see, e.g., 2022 Iowa Acts, chapter 1147, section 22). 23 BILL’S PROVISIONS. The bill changes the name of the member 24 organization appointing a poultry producer and adds a member 25 organization appointing a turkey producer. The bill provides 26 that the council is to meet at Iowa state university rather 27 than the department of agriculture and land stewardship. A 28 member is not entitled to receive compensation or expenses. 29 The purpose of the council is to support research of livestock 30 diseases, and it must make its recommendations to the college 31 by the first day of the fiscal year (July 1 through June 30). 32 The college is expressly authorized to use moneys in the fund 33 to conduct research of diseases affecting livestock. 34 -4- LSB 2274XS (3) 90 da/ns 4/ 4
