S.F. 388 Section 1. Section 8B.7, subsection 1, Code 2023, is amended 1 to read as follows: 2 1. The provisions of this chapter and rules adopted pursuant 3 to this chapter shall, with respect to federal funds, be solely 4 procedural or address only subjects expressly delegated to the 5 state. Eligibility and allocation of federal funds shall be 6 governed by federal definitions, criteria, scoring, and rules. 7 Neither the provisions of this chapter nor rules adopted 8 pursuant to this chapter shall apply in any situation where 9 such provision or rule is in conflict with a governing federal 10 regulation or where the provision or rule would jeopardize 11 the receipt of federal funds , or where the provision or rule 12 would modify the federal definition or criteria for eligibility 13 regarding the allocation of federal funds . 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to conflicts between federal funding and 18 the office of the chief information officer. 19 The bill provides that federal funds shall only be subject 20 to procedural or express state authority regarding rules 21 or provisions under the office of the chief information 22 officer established in Code chapter 8B. The bill provides 23 that federal definitions, criteria, scoring, and rules shall 24 govern the eligibility and allocation of federal funds. The 25 bill additionally provides that provisions of Code chapter 26 8B and rules adopted pursuant to the Code chapter shall not 27 apply where such provisions or rules would modify a federal 28 definition or criteria for eligibility regarding the allocation 29 of federal funds. 30 -1- LSB 2314SV (1) 90 es/rn 1/ 1
