An apartment building consisting of three or more floors 3 shall include a passenger elevator if the owner or builder 4 of the apartment building received funding or other valuable 5 consideration from the state or a political subdivision of the 6 state in connection with the construction of the apartment 7 building. 8 2. This section applies to apartment buildings under 9 construction on or after the effective date of this Act unless 10 the person responsible for the construction on the effective 11 date of this Act determines that the construction has reached a 12 state where compliance will result in a substantial increase in 13 cost or delay in construction. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to the construction of apartment buildings 18 using public funds. The bill requires that an apartment 19 building consisting of three or more floors include a passenger 20 elevator if the owner or builder of the apartment building 21 received funding or other valuable consideration from the state 22 or a political subdivision of the state in connection with 23 the construction of the apartment building. The bill applies 24 to apartment buildings under construction on or after the 25 effective date of the bill unless the person responsible for 26 the construction on the effective date of the bill determines 27 that the construction has reached a state where compliance 28 will result in a substantial increase in cost or delay in 29 construction. 30 By operation of law, a person who violates a provision of the 31 bill is guilty of a simple misdemeanor.
