S.F. 34 Section 1. Section 331.301, Code 2023, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 22. A county shall not adopt, enforce, 3 or otherwise administer an ordinance, motion, resolution, 4 or amendment providing for any terms or conditions of storm 5 water regulation that exceed or conflict with federal or 6 state statutes or regulations relating to storm water runoff, 7 discharge, retention, or management. 8 Sec. 2. Section 364.3, Code 2023, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 18. A city shall not adopt, enforce, 11 or otherwise administer an ordinance, motion, resolution, 12 or amendment providing for any terms or conditions of storm 13 water regulation that exceed or conflict with federal or 14 state statutes or regulations relating to storm water runoff, 15 discharge, retention, or management. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill prohibits a county or city from adopting, 20 enforcing, or otherwise administering an ordinance, motion, 21 resolution, or amendment providing for any terms or conditions 22 of storm water regulation that exceed or conflict with federal 23 or state statutes or regulations relating to storm water 24 runoff, discharge, retention, or management. 25 -1- LSB 1480XS (4) 90 js/ns 1/ 1
