1.
All
newly
constructed
buildings
or
structures
subject
to

the
state
building
code,
including
any
addition,
but
excluding

any
renovation
or
repair
of
such
a
building
or
structure,
owned
11
by
the
state
or
an
agency
of
the
state,
except
as
provided
in
12
subsection
2
,
shall
be
subject
to
a
plan
review
and
inspection
13
by
the
commissioner
or
an
independent
building
inspector
14
appointed
by
the
commissioner.
Any
renovation
or
repair
15
of
such
a
building
or
structure
shall
be
subject
to
a
plan
16
review,
except
as
provided
in
subsection
2
.
A
fee
shall
be
17
assessed
for
the
cost
of
plan
review,
and,
if
applicable,
the
18
cost
of
inspection.
The
commissioner
may
inspect
an
existing
19
building
that
is
undergoing
renovation
or
remodeling
to
enforce
20
the
energy
conservation
requirements
established
under
this
21
chapter
.

2.
All
newly
constructed
buildings,
including
any
addition,
23
but
excluding
any
renovation
or
repair
of
a
building,
owned
by
24
the
state
board
of
regents
shall
be
subject
to
a
plan
review
25
and
inspection
by
the
commissioner
or
the
commissioner’s
26
staff
or
assistant.
A
renovation
of
a
building
owned
by
the
27
state
board
of
regents
shall
be
subject
to
a
plan
review.
28
The
commissioner
may
inspect
an
existing
building
that
is
29
undergoing
renovation
or
remodeling
to
enforce
the
energy
30
conservation
requirements
established
under
this
chapter
.
The
31
commissioner
and
the
state
board
of
regents
shall
develop
a
32
plan
to
implement
this
provision.

5.
Section
103A.19,
subsection
1,
Code
2023,
is
amended

1.
The
examination
and
approval
or
disapproval
of
plans
1
and
specifications,
the
issuance
and
revocation
of
building
2
permits,
licenses,
certificates,
and
similar
documents,
the
3
inspection
of
buildings
or
structures,
and
the
administration
4
and
enforcement
of
building
regulations
shall
be
the
5
responsibility
of
the
governmental
subdivisions
of
the
6
state
and
shall
be
administered
and
enforced
in
the
manner
7
prescribed
by
local
law
or
ordinance.
All
provisions
of
8
law
relating
to
the
administration
and
enforcement
of
local
9
building
regulations
in
any
governmental
subdivision
shall
be
10
applicable
to
the
administration
and
enforcement
of
the
state
11
building
code
in
the
governmental
subdivision.
An
application
12
made
to
a
local
building
department
or
to
a
state
agency
for
13
permission
to
construct
a
building
or
structure
pursuant
to
the
14
provisions
of
the
state
building
code
shall,
in
addition
to
15
any
other
requirement,
be
signed
by
the
owner
or
the
owner’s
16
authorized
agent,
and
shall
contain
the
address
of
the
owner,
17
and
a
statement
that
the
application
is
made
for
permission
to
18
construct
in
accordance
with
the
provisions
of
the
code.
The
19
application
shall
also
specifically
include
a
statement
that
20
the
construction
will
be
in
accordance
with
all
applicable
21
energy
conservation
requirements.

Sec.
6.
Section
103A.19,
subsection
3,
Code
2023,
is
amended
23
by
striking
the
subsection.

Sec.
7.
Section
103A.22,
subsection
1,
Code
2023,
is
amended
25
to
read
as
follows:

1.
Nothing
in
this
chapter
shall
be
construed
as
prohibiting
27
any
governmental
subdivision
from
adopting
or
enacting
any
28
building
regulations
relating
to
any
building
or
structure
29
within
its
limits,
but
a
governmental
subdivision
in
which
30
the
state
building
code
has
been
accepted
and
is
applicable
31
shall
not
have
the
power
to
supersede,
void,
or
repeal
or
make
32
more
restrictive
any
of
the
provisions
of
this
chapter
or
of
33
the
rules
adopted
by
the
commissioner.
This
subsection
shall
34
not
apply
to
energy
conservation
requirements
adopted
by
the
35

commissioner
and
approved
by
the
council
pursuant
to
section
1
103A.8A
or
103A.10
.

9.
REPEAL.
Section
103A.8A,
Code
2023,
is
repealed.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
repeals
a
requirement
that
the
state
building
9
code
commissioner
adopt
energy
conservation
requirements
for
10
new
single-family
and
two-family
residential
construction.
11
The
bill
strikes
provisions
applying
the
energy
conservation
12
requirements
to
other
construction
in
the
state
and
requiring
13
compliance
with
energy
conservation
requirements.
