Section
1.
Section
144.26,
Code
2024,
is
amended
by
adding
1
the
following
new
subsection:
2
NEW
SUBSECTION
.
3A.
The
department
shall
provide
for
3
correction
to
the
medical
certification
of
cause
of
death
and
4
substitution
of
a
death
certificate
if
evidence
substantiating
5
the
correction
and
substitution
is
presented
to
the
state
6
registrar
within
twelve
months
of
the
date
of
death
of
the
7
decedent.
A
correction
to
the
medical
certification
of
8
the
cause
of
death
and
substitution
of
a
death
certificate
9
requested
after
twelve
months
of
the
date
of
death
of
the
10
decedent
shall
be
made
by
order
of
a
court
of
competent
11
jurisdiction
and
considered
an
amendment
of
official
record
12
pursuant
to
section
144.38.
The
substituted
death
certificate
13
shall
comply
with
requirements
pursuant
to
sections
144.38
and
14
144.41.
A
fee
shall
not
be
charged
for
a
correction
to
and
15
substitution
of
a
death
certificate
under
this
subsection.

EXPLANATION
17
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
correction
and
substitution
of
20
death
certificates.
21
The
bill
requires
the
department
of
health
and
human
22
services
to
provide
for
correction
to
the
medical
certification
23
of
cause
of
death
and
substitution
of
a
death
certificate
24
if
evidence
substantiating
the
correction
and
substitution
25
is
presented
to
the
state
registrar
within
12
months
of
the
26
date
of
death
of
the
decedent.
A
correction
to
the
medical
27
certification
of
the
cause
of
death
and
substitution
of
a
28
death
certificate
requested
after
12
months
of
the
date
of
29
death
of
the
decedent
shall
be
made
by
order
of
a
court
of
30
competent
jurisdiction
and
considered
an
amendment
of
official
31
record.
The
substituted
death
certificate
shall
comply
with
32
requirements
relating
to
the
amendment
of
an
official
record
33
and
the
amending
of
local
records.
A
fee
shall
not
be
charged

for
a
correction
to
and
substitution
of
a
death
certificate
